incompatible with or in conflict with any of his official
duties or acts, he shall disclose [such] THE interest in
a REGULAR PUBLIC meeting of the Commission OR THE
PLANNING BOARD and [such] THE disclosure shall appear in
the [Commissions] minutes, and he shall disqualify
himself and not participate in the decision or act
affected thereby.

[(f)] (D) Any commissioner convicted of violating
subsection [(d) ] (A) or [(e) ] (B) of this section [shall
be] IS guilty of a misdemeanor, and shall be punishable
by a fine of not more than [$1,000,00] $1,000 or six
months in jail, or both [such] fine and imprisonment, or
by suspension from the Commission or employment for not
more than six months, or by outright forfeiture and
removal from office, or by any combination of these, as
in the discretion of the court [shall be] IS fit and
proper.

[(g)] (E) The provisions of this section are
severable[, and if any provision of this section or
subsection thereof, or the application thereof to any
person or circumstance is held invalid for any reason,
such invalidity shall not affect the other provisions,
section, subsection thereof, or any other application of
this section which can be given effect without the
invalid provisions, subsections or application] AND ARE
AS PROVIDED IN ARTICLE 1, SECTION 23 OF THE ANNOTATED
CODE OF MARYLAND.

[14.] 2-116.

In the performance of the functions and duties of
the Commission, any member or any employee or agent of
the Commission [has the right to] MAY enter at all
reasonable hours upon any private premises and into any
building in the Maryland—Washington Metropolitan District
or in the Maryland—Washington Regional District, in order
to make examinations and surveys and to place and
maintain necessary monuments and marks thereon. Any
restraint or hindrance offered to [any such] THE entry,
examination, survey, or placing or maintenance of
monuments or marks by any owner or tenant or agent of an
owner or tenant [shall be] IS a misdemeanor, punishable
as such under the general penalty provisions of this
[subtitle] ARTICLE.

[15.] 2-117.

The members of the Commission and its staff [are
authorized to] MAY engage in civilian defense or other
defense activities under the direction of, or in
cooperation with, federal, state, or county agencies
having charge of such defense activities.
