11-706. COMPLIANCE WITH OTHER STATUTES AND REGULATIONS.
IN ANY ACTION BROUGHT UNDER THIS SUBTITLE, IT IS A
DEFENSE THAT THE ADVERTISEMENT CONCERNING WHICH THE
ACTION IS BROUGHT IS SUBJECT TO AND COMPLIES WITH THE
RULES AND REGULATIONS OF AND THE STATUTES ADMINISTERED BY
THE FEDERAL TRADE COMMISSION OR ANY UNIT OF THE STATE
GOVERNMENT.
REVISOR'S NOTE: This section presently appears as
the last sentence of Art. 27, §195A(c).
The reference to a "complete" defense is
deleted as unnecessary.
The term "unit of the State Government" is
substituted for the reference to "office,
department, division, commission or agency"
for purposes of simplicity. The term "unit" is
recommended by the Commission as a general
nomenclature for organizational elements of
government because it has a broad and
nondescript connotation. Terms such as
"department," "division," "agency," and the
like are avoided due to their varied,
sometimes substantive, applications.
The only other changes are in style.
11-707. PRIVATE LITIGATION UNAFFECTED.
THIS SUBTITLE DOES NOT MODIFY ANY RIGHT OF A PERSON
IN PRIVATE LITIGATION.
REVISOR'S NOTE: This section presently appears as
the first sentence of Art. 27, §195A(e).
The second sentence of that subsection, which
provides against implied repeal of Art. 27,
§195, is deleted as unnecessary.
The only other changes are in style.
GENERAL REVISOR'S NOTE
Although the statutory treatment of
"consumer"—directed advertising and related "consumer"
protection provisions are contained in Titles 13 and 11
of this article, the provisions contained in this
subtitle have been placed in the more general Trade
Regulation Title in light of their broad applicability to
any false advertising in the conduct of any trade,
business or commerce.
