MANAGEMENT OF THE ENTERPRISE IN WHICH HE IS EMPLOYED OR
OF A CUSTOMARILY RECOGNIZED DEPARTMENT OR SUBDIVISION OF
THAT ENTERPRISE; AND
(B) WHO CUSTOMARILY AND REGULARLY DIRECTS
THE WORK OF TWO OR MORE OTHER EMPLOYEES IN THAT
ENTERPRISE, DEPARTMENT OR SUBDIVISION OF THAT ENTERPRISE;
AND
(C) WHO EITHER HAS THE AUTHORITY TO HIRE OR
FIRE OTHER EMPLOYEES OR WHOSE SUGGESTIONS AND
RECOMMENDATIONS AS TO THE HIRING AND FIRING AND AS TO THE
ADVANCEMENT AND PROMOTION OR ANY OTHER CHANGE OF STATUS
OF OTHER EMPLOYEES WILL BE GIVEN PARTICULAR WEIGHT; AND
(D) WHO CUSTOMARILY AND REGULARLY EXERCISES
DISCRETIONARY POWERS.
6. FOR THE PURPOSES OF THIS SECTION, A
PROFESSIONAL EMPLOYEE SHALL MEAN ANY EMPLOYEE WHOSE
PRIMARY DUTIES CONSIST OF THE PERFORMANCE OF WORK
REQUIRING KNOWLEDGE OF AN ADVANCED TYPE IN A FIELD OF
SCIENCE OR LEARNING CUSTOMARILY ACQUIRED BY A PROLONGED
COURSE OF SPECIALIZED INTELLECTUAL INSTRUCTION AND STUDY.
7. NOTWITHSTANDING ANY AGREEMENT TO THE CONTRARY
BETWEEN A MERCHANT AND HIS LANDLORD, NO MERCHANT MAY BE
REQUIRED TO OPEN HIS PLACE OF BUSINESS ON SUNDAY.
[[SECTION 2. AND BE IT FURTHER ENACTED, That this
Act shall take effect July 1, 1975.]]
SECTION 2. AND BE IT FURTHER ENACTED. That before
this Act becomes effective it shall first be submitted to
a referendum of the legally qualified voters of Prince
George's County at the general election to be held in
November of 1976. The County Council and the Board of
Supervisors of Elections of Prince George's County shall
do those things necessary and proper to provide for and
hold the referendum here required. There shall be
printed on the ballots or ballot labels to be used at
this election the title of this Act and underneath the
title, on separate lines, a square or box to the right of
and opposite the words: "For Business on Sundays" and a
corresponding square or box to the right of and opposite
the words "Against Business on Sundays" so that each
voter of the county may designate his or her decision for
or against the provisions of this Act. If a majority of
the votes cast in the election are "For business on
Sundays" the provisions of this Act shall become
effective on the 30th day following the official canvass
of votes for the referendum, but if a majority of the
votes cast in the election are "Against Business on
