THIS SUBTITLE MAY BE CITED AS THE MARYLAND UNFAIR
SALES ACT.

REVISOR'S NOTE: This section presently appears as
Art. 83, §111.

The reference to "Maryland" is added to
distinguish this subtitle from the Unfair
Sales Acts of other jurisdictions.

The only other changes are in style.

GENERAL REVISOR'S NOTE

In revising this subtitle, the Commission to Revise
the Annotated Code concluded that present Art. 83, §115
is unnecessary and repetitious in light of the general
severability provisions of Art. 1, §23. Accordingly,
Art. 83, §115 is proposed for repeal.

SUBTITLE 5. UNFAIR CIGARETTE SALES ACT.

11-501. DEFINITIONS.

(A)   IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

REVISOR'S NOTE: This subsection is new language used
as the standard introductory language to a
definition section.

(B)       BASIC COST OF CIGARETTES.

"BASIC COST OF CIGARETTES" MEANS THE LESSER OF THE
INVOICE COST OR THE REPLACEMENT COST OF CIGARETTES TO THE
RETAILER OR WHOLESALER; PLUS ANY IN-FREIGHT CHARGE TO THE
WHOLESALER OTHERWISE NOT INCLUDED IN THE INVOICE COST OR
THE REPLACEMENT COST; MINUS ANY TRADE DISCOUNT OR
DISCOUNT FOR CASH.

REVISOR'S NOTE: This subsection presently appears as
Art. 83, §118(a), except for that section's
parenthetical definition of "replacement cost"
which now appears in subsection (g) of this
section.
