AN ACT concerning

Public Education — [[Self Insurance]] Legal
Represent at ion

FOR the purpose of requiring the Boards of Education who
self—insure for the comprehensive liability of
itself, its agents and employees to submit certain
data: and providing for legal representation in
certain instances.

BY repealing and re—enacting, with amendments,

Article 77 — Public Education

Section 56B(c)

Annotated Code of Maryland

(1969 Replacement Volume and 1974 Supplement)

BY adding to

Annotated Code of Maryland

(1969 Replacement Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 56B (c) of Article 77 - Public
Education, of the Annotated Code of Maryland (1969
Replacement Volume and 1974 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:

Article 77 — Public Education

56B.

(c) Any of the above boards of education shall be
considered in compliance herein if they are self—insured
in an amount not less than one hundred thousand dollars
($100,000.00) per occurrence under rules and regulations
promulgated by the State Insurance Commissioner. ANY
BOARD ELECTING TO SELF-INSURE UNDER THE PROVISIONS OF
THIS PARAGRAPH SHALL FILE PERIODICALLY WITH THE STATE
INSURANCE COMMISSIONER IN WRITING, THE TERMS AND
CONDITIONS OF THE SELF INSURANCE, THOSE TERMS AND
CONDITIONS TO BE SUBJECT TO THE APPROVAL OF THE STATE
INSURANCE COMMISSIONER AND IN CONFORMITY WITH THE TERMS
AND CONDITIONS OF COMPREHENSIVE LIABILITY INSURANCE
POLICIES AVAILABLE IN THE PRIVATE MARKET.
