It is a synthesis of the U.C.C. definitions of
"person" and "organization" contained in
§1—201(28) and (30) of this article, except
that the reference to "government or
governmental subdivision or agency" is not
included. This definition is in no way
intended to change the existing law, merely to
clarify it,

(F) RETAIL SALE.

"RETAIL SALE" MEANS THE SALE OF A PRODUCT FOR
PURPOSES OTHER THAN RESALE.

Art. 23, §167C(5).

The defined words "retail sale" are

substituted for "retail" for purposes of

clarity, as well as conformity with the
general usage in this subtitle.

11-302. LEGISLATIVE DECLARATION; STATEMENT OF PUBLIC
POLICY.

(A)   LEGISLATIVE FINDING AND DECLARATION.

THE GENERAL ASSEMBLY FINDS AND DECLARES THAT SINCE
THE DISTRIBUTION AND SALE THROUGH MARKETING ARRANGEMENTS
OF PETROLEUM PRODUCTS IN THE STATE VITALLY AFFECT THE
ECONOMY OF THE STATE, AND ITS PUBLIC INTEREST, WELFARE,
AND TRANSPORTATION, IT IS NECESSARY TO DEFINE THE
RELATIONSHIPS AND RESPONSIBILITIES OF THE PARTIES TO
CERTAIN AGREEMENTS PERTAINING TO THESE MARKETING
ARRANGEMENTS.

(B)   STATEMENT OF PUBLIC POLICY.

THIS SUBTITLE CONSTITUTES A STATEMENT OF THE PUBLIC
POLICY OF THE STATE.
