any of the county boards except in Allegany, Carroll,
Charles, Howard, KENT, Prince George's, Montgomery and
Washington counties for any cause shall be filled by the
Governor for the unexpired term and until a successor
shall qualify. Any member of a board shall be eligible
for reappointment unless otherwise disqualified by the
provisions of this section; provided however:
(1) [That] EXCEPT IN KENT COUNTY, THAT no person
shall be eligible to serve more than two consecutive
terms and
(2) That an incumbent member of a county board
serving a full term as of July 1, 1969, shall be eligible
for one additional full term.
SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 36E be and it is hereby added to Article 77 —
Public Education, of the Annotated Code of Maryland (1969
Replacement Volume and 1974 Supplement) to read as
follows:
Article 77 — Public Education
36E.
(A) (1) THE OFFICES HELD BY THE MEMBERS OF THE
BOARD OF EDUCATION OF KENT COUNTY ARE ABOLISHED ON
DECEMBER 31, 1976, THE INCUMBENTS EXERCISING THE
FUNCTIONS AND DUTIES OF THE BOARD ON THAT DATE SHALL HOLD
OFFICE UNDER THE PROVISIONS OF THIS SECTION AS INTERIM
INCUMBENTS OF THE OFFICES PROVIDED IN THIS SECTION TO
SERVE FOR SUCH TERMS AS SPECIFIED BY THIS SECTION AND
UNTIL THEIR RESPECTIVE SUCCESSORS ARE ELECTED AND
QUALIFIED.
(2) ON JANUARY 1, 1977, THE BOARD OF
EDUCATION OF KENT COUNTY IS COMPOSED OF FIVE MEMBERS
ELECTED FROM THE COUNTY AT LARGE. ALL CANDIDATES ELECTED
TO THE BOARD SHALL BE RESIDENTS AND REGISTERED VOTERS OF
THE COUNTY. ANY MEMBER WHO CEASES TO BE A RESIDENT OF
KENT COUNTY IS NO LONGER A MEMBER OF THE BOARD. THE TERM
OF EACH MEMBER OF THE BOARD COMMENCES ON JANUARY 1 OF THE
YEAR FOLLOWING THEIR ELECTION.
(3) THE MEMBERS OF THE KENT COUNTY BOARD OF
EDUCATION SHALL HOLD OFFICE FOR A TERM OF SIX YEARS AND
BE ELECTED AS FOLLOWS:
(I) TWO MEMBERS OF THE BOARD SHALL BE
ELECTED IN THE NOVEMBER GENERAL ELECTION OF 1978, AND
EVERY SIX YEARS THEREAFTER, TO REPLACE THE TWO INTERIM
INCUMBENT MEMBERS OF THE BOARD WHOSE TERMS EXPIRE IN 1977
