CHAPTER 694
(House Bill 545)

AN ACT concerning

Watershed Property — Citations for Offenses Thereon

FOR the purpose of authorizing law enforcement officers,
including special policemen, to issue citations for
violation of laws or regulations on publicly—owned
watershed property; and generally relating to
watershed property.

BY adding to

Article 41 — Governor—Executive and Administrative

Departments
Section 64(a)

Annotated Code of Maryland
(1971 Replacement Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 64(a) be and it is hereby
added to Article 41 — Governor—Executive and
Administrative Departments, of the Annotated Code of
Maryland (1971 Replacement Volume and 1974 Supplement) to
read as follows:

64.

(A)    WHENEVER A PERSON IS HALTED BY A REGULAR OR
SPECIAL POLICE OFFICER FOR AN OFFENSE ON PUBLICLY-OWNED
WATERSHED PROPERTY PUNISHABLE AS A MISDEMEANOR AND WHICH
IS EITHER A VIOLATION OF LAW OR A VIOLATION OF WATERSHED
REGULATIONS, AND IS NOT TAKEN BEFORE A DISTRICT COURT
COMMISSIONER AS WOULD OTHERWISE BE REQUIRED OR IS
PERMITTED BY LAW, THE OFFICER MAY PREPARE A WRITTEN
CITATION CONTAINING A NOTICE TO APPEAR IN COURT, THE NAME
AND ADDRESS OF THE PERSON, THE OFFENSE CHARGED, THE TIME
AND PLACE THE PERSON SHALL APPEAR IN COURT, AND WHATEVER
OTHER PERTINENT INFORMATION AS NECESSARY.

(B)    THE TIME SPECIFIED IN THE NOTICE TO APPEAR
SHALL BE AT LEAST FIVE DAYS AFTER THE ALLEGED VIOLATION
UNLESS THE PERSON CHARGED WITH THE VIOLATION DEMANDS AN
EARLIER HEARING.
