PLACE OF BUSINESS IS LOCATED. IN CASES OF NON-RESIDENTS,
THE APPEAL SHALL BE FILED WHERE THE NON-RESIDENT WAS
CONVICTED OF THE VIOLATION.

(2)    IF JURISDICTION IS NOT OTHERWISE
PROVIDED IN THIS ARTICLE, THE CIRCUIT COURT FOR ANNE
ARUNDEL COUNTY HAS JURISDICTION.

(3)    THE PROVISIONS OF THE ADMINISTRATIVE
PROCEDURE ACT SHALL GOVERN IN AN APPEAL.

(1) IF AN APPEAL IS NOTED IN A CASE
[[CONCERNING MOTOR VEHICLE OPERATOR LICENSING, THE
ADMINISTRATION MAY STAY ITS ORDER PENDING DETERMINATION
OF THE APPEAL. IN A CASE CONCERNING ANY OTHER LICENSING,
THE ADMINISTRATION SHALL STAY ITS ORDER PENDING
DETERMINATION OF THE APPEAL.]] THE ADMINISTRATION SHALL
GRANT A STAY OF ITS ORDER FOR NOT MORE THAN 60 DAYS
UNLESS IT APPEARS TO THE ADMINISTRATION THAT SUBSTANTIAL
AND IMMEDIATE DANGER AND HARM COULD RESULT TO THE
LICENSEE OR OTHERS IF THE LICENSE IS CONTINUED PENDING
APPEAL

SECTION 2. AND BE IT FURTHER ENACTED, That Sections
5-502, 5-602, 5-707, 5-808, 6-206, 6-207, and 6-505 of
Article 66 1/2 — Vehicle Laws, of the Annotated Code of
Maryland (1970 Replacement Volume and 1974 Supplement) be
and they are hereby repealed and re—enacted, with
amendments, to read as follows:

Article 66 1/2 - Vehicle Laws

5-502.

(A) [The Department shall suspend or revoke any
license issued under this subtitle or authority to do
business only after a hearing. At least 10 days prior
to the date set for the hearing, the Department shall
notify the licensee in writing of any charge made and
afford the licensee an opportunity to be heard in person
and by counsel in reference thereto. The written notice
shall be served by delivery to the licensee by registered
mail to the business address of the licensee of record
with the Department. The hearing on the charges shall
be at such time and place as the Department shall
prescribe. The Department may subpoena and bring before
it any person or documents, and take the testimony of any
person under oath in the same manner as is prescribed in
judicial procedure in the courts of this State in civil
cases, with the same fees and mileage as may be provided
by law in civil cases.]

THE ADMINISTRATION MAY SUSPEND OR REVOKE ANY LICENSE
