260.

The State [Roads Commission shall] HIGHWAY

ADMINISTRATION MAY not expend any funds to control

outdoor advertising pursuant to the Highway

Beautification Act of 1965, AND THE FEDERAL-AID HIGHWAY

AMENDMENT OF 1974, until appropriate matching federal
funds are available under such [act] ACTS.

SECTION 2. AND BE IT FURTHER ENACTED, That new
Sections 231A, 231B, 233A and 233B be and they are hereby
added to Article 89B — State Roads, of the Annotated Code
of Maryland (1969 Replacement Volume and 1974 Supplement)
to read as follows:

Article 89B — State Roads

231A.

AFTER JULY 1, 1975, A PERSON, FIRM, OR CORPORATION
MAY NOT LEASE, RENT, USE, OR PERMIT THE USE OF HIS, HER,
OR ITS PROPERTY FOR THE PURPOSE OF ERECTING THEREON ANY
OUTDOOR ADVERTISING SIGNS OF ANY KIND ADJACENT TO ANY
EXPRESSWAY, INCLUDING THE INTERSTATE SYSTEM OF HIGHWAYS,
WHICH IS LOCATED BEYOND 660 FEET OF THE RIGHT-OF-WAY LINE
OF ANY EXPRESSWAY WITHIN THE STATE INCLUDING THE
INTERSTATE SYSTEM OF HIGHWAYS, AND LOCATED OUTSIDE OF
URBAN AREAS, WHICH IS VISIBLE FROM THE TRAVELING WAY OF
THE HIGHWAY, AND ERECTED WITH THE PURPOSE OF THEIR
MESSAGE BEING READ FROM SUCH MAIN TRAVELED WAY EXCEPT AS
HEREINAFTER PROVIDED.

231B.

FOR THE PURPOSE OF THIS SECTION AND SECTIONS 232 AND
233, THE TERM "OUTDOOR ADVERTISING" MEANS ANY OUTDOOR
SIGN, DISPLAY, DEVICE, FIGURE, PAINTING, DRAWING,
MESSAGE, PLACARD, POSTER, BILLBOARD, OR OTHER THING WHICH
IS DESIGNED, INTENDED, OR USED TO ADVERTISE OR INFORM.

233A.

THE STATE HIGHWAY ADMINISTRATION MAY ACQUIRE BY
PURCHASE, GIFT, OR CONDEMNATION, AND PAY JUST
COMPENSATION UPON ITS REMOVAL, ANY OUTDOOR ADVERTISING
SIGN LOCATED BEYOND 660 FEET OF THE RIGHT-OF-WAY LINE OF
ANY EXPRESSWAY WITHIN THE STATE, INCLUDING THE INTERSTATE
SYSTEM OF HIGHWAYS, AND LOCATED OUTSIDE OF URBAN AREAS,
IF THE ADVERTISING SIGN WAS ERECTED PRIOR TO JULY 1,
1975. COMPENSATION MAY NOT BE PAID FOR ANY SIGN ERECTED
SUBSEQUENT TO JULY 1, 1975 WHICH IS VISIBLE FROM THE MAIN
TRAVELED WAY OF SUCH HIGHWAY, AND WHICH IS ERECTED WITH
THE PURPOSE OF ITS MESSAGE BEING READ FROM SUCH MAIN
