receive less than the benefits to which he would be
entitled under the provisions of $195 of this article;
provided further that any member retired prior to July 1,
1973, shall, in no instance, receive less benefits than
he had received prior to such date. Any member who
retired prior to July 1, 195 8 with thirty or more years
of service shall not receive benefits in any amount less
than [$4,000] $5,000 per annum.

SECTION 3. AND BE IT FURTHER ENACTED, That Sections
34A(e) and 53A(e) of Article 88B - State Police, of the
Annotated Code of Maryland (1969 Replacement Volume and
1974 Supplement) be and they are hereby repealed and
re-enacted, with amendments, to read as follows:

34A.

(e) In no instance shall any retired member
receive less than the benefits to which he would be
entitled under the provisions of § 31 of this article
provided further that any member retired prior to July 1,
1973, shall, in no instance, receive less benefits than
he had received prior to such date. Any member who
retired prior to July 1, 1958 with thirty (30) or more
years of service shall not receive benefits in any amount
less than [four thousand dollars ($4,000)] $5,000 per
annum.

53A.

(e) In no instance shall any retired member
receive less than the benefits to which he would be
entitled under the provisions of § 53 of this article
provided further that any member retired prior to July 1,
1973, shall, in no instance, receive less benefits than
he had received prior to such date. Any member who
retired prior to July 1, 1958 with thirty (30) or more
years of service shall not receive benefits in any amount
less than [four thousand dollars ($1,000)] $5,000 per
annum.

SECTION [[2]]4. AND BE IT FURTHER ENACTED, That
this Act [[shall take effect July 1, 1975.]] is hereby
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety
and having been passed by a yea and nay vote supported by
three—fifths of all the members elected to each of the
two Houses of the General Assembly, the same shall take
effect from the date of its passage.
