(1)    WHICH IS ON HIS PERSON;

(2)    WHICH IS IN ANY CONTAINER CARRIED BY
HIM; OR IF HE IS SHOWN TO HAVE JUST CAST AWAY A BOMB FROM
HIM TO AVOID CAPTURE, WITH IT IN HIS POSSESSION;

(3)     WHICH HE DEPOSITED AT A PLACE WHERE HE
INTENDED FOR IT TO BE EXPLODED OR WHERE IT MIGHT HAVE
EXPLODED AND CAUSED DAMAGE TO THE LIFE, HEALTH OR
PROPERTY OF ANOTHER; OR

(4) WHO HAS IN HIS POSSESSION ANY COMPONENT
PART OF A BOMB WHICH, IF COMBINED WITH ANY OTHER
MATERIAL OR CONTRIVANCE, COULD OR WOULD BE CALCULATED TO
EXPLODE AND DAMAGE PROPERTY, LIFE OR HEALTH.

(C)     WHOEVER MANUFACTURES, OWNS, STORES, KEEPS,
SELLS, TRANSPORTS, POSSESSES OR HAS IN HIS CONTROL A
BOMB, AS DEFINED IN SECTION 1, IS GUILTY OF A FELONY AND
UPON CONVICTION SHALL BE CONFINED FOR NOT LESS THAN FIVE
YEARS AND NOT MORE THAN 25 YEARS AND FINED NOT LESS THAN
$1,000 AND NOT MORE THAN $10,000, OR EITHER OF THEM.

(D)    (1) THE PROVISIONS OF THIS SUBHEADING DO NOT
APPLY:

(I)    TO DULY CONSTITUTED POLICE OR LAW
ENFORCEMENT OFFICERS;

(II)    TO MEMBERS OF THE MILITARY, NAVAL
OR AIR FORCE ESTABLISHMENTS WHEN ACTING WITHIN THEIR
OFFICIAL CAPACITIES;

(III)    TO LICENSED AND RECOGNIZED
MANUFACTURERS STORES OR DEALERS IN PEST DESTROYERS,
CHEMICAL SUBSTANCES OR LABORATORY SUPPLIES OF ANY KIND;

(IV)    TO LICENSED PHYSICIANS, SURGEONS,
CHEMISTS, PHARMACISTS, NURSES OR HOSPITAL EMPLOYEES IN
THEIR USUAL EMPLOYMENT;

(V)     TO RAILROADS, COMMERCIAL TRUCKERS
OR RECOGNIZED OPERATORS OR LICENSED DEALERS WHO TRANSPORT
OR USE DYNAMITE OR OTHER EXPLOSIVES IN LEGITIMATE MINING,
OIL DEVELOPING, MANUFACTURING OR DISPLAYING OF FIREWORKS;

(VI)    TO TORPEDOES, FUSES AND OTHER
INFLAMMABLE OR EXPLOSIVE SUBSTANCES USED BY RAILROADS AS
WARNING OR SIGNAL DEVICES;

(VII)  TO PERSONS MANUFACTURING, STORING,
TRANSPORTING OR SELLING AMMUNITION WHERE THE PERSONS ARE
ENGAGED REGULARLY IN THE LEGITIMATE BUSINESS OF DEALING
IN THOSE SUBSTANCES;
