PERMITS REQUESTED. SUBJECT TO THE PROVISIONS OF § 64,
THE HEARING SHALL BE CONDUCTED BY THE COORDINATOR OR A
HEARING EXAMINER DESIGNATED BY HIM NOT LESS THAN 30 DAYS
NOR MORE THAN 90 DAYS AFTER THE RECEIPT OF THE COMPLETED
APPLICATION, APPENDICES, AND INFORMATION AT A CONVENIENT
PLACE IN THE COUNTY WHERE THE PROJECT IS TO BE LOCATED.
IF THE PROJECT IS TO BE LOCATED IN MORE THAN ONE COUNTY,
THE HEARING SHALL BE HELD IN THE COUNTY WHERE THE
GREATEST PART OF THE AREA TO BE DEVELOPED IS LOCATED. IF
THE PROJECT IS LOCATED IN ONE COUNTY BUT AFFECTS ANY
OTHER COUNTY, THE HEARING SHALL BE HELD IN THE COUNTY
RECEIVING THE GREATEST IMPACT FROM THE PROJECTS AS
DETERMINED BY THE COORDINATOR. THE COORDINATOR MAY
CONDUCT HEARINGS IN ANOTHER COUNTY OR MAY CONTINUE THE
FIRST HEARING IN ANOTHER COUNTY.
(D) NEITHER THIS SECTION NOR § 59 SHALL BE
CONSTRUED TO REQUIRE A HEARING, OR TO REQUIRE THAT A
STATE AGENCY PARTICIPATE IN A HEARING ON AN APPLICATION
BEFORE IT IF THE LAW GOVERNING THE PERMIT APPLIED FOP
DOES NOT REQUIRE A HEARING. A STATE AGENCY WHICH DOES
NOT CONDUCT A HEARING SHALL PROCEED IN ACCORDANCE WITH
THE LAW AND PROCEDURES APPLICABLE TO THE ISSUANCE OF
PERMITS BY IT. EXCEPT THAT IT SHALL COMPLY WITH § 63(D)
OF THIS SUBTITLE.
61. NOTICE OF HEARING
(A) UPON RECEIVING NOTICE OF THE TIME, DATE, AND
PLACE OF A JOINT OR CONSOLIDATED HEARING, THE APPLICANT
SHALL GIVE PUBLIC NOTICE OF THE APPLICATION AND HEARING.
THE NOTICE SHALL BE GIVEN BY PUBLICATION ONE IN EACH OF
TWO SUCCESSIVE WEEKS PRIOR TO THE HEARING IN A NEWSPAPER
OF GENERAL CIRCULATION WITHIN EACH COUNTY IN WHICH THE
PROJECT IS TO BE LOCATED. THE COORDINATOR SHALL CAUSE
THE NOTICE TO BE PUBLISHED ALSO IN THE MARYLAND REGISTER.
(B) THE NOTICE SHALL CONTAIN:
(1) A DESCRIPTION OF THE PROJECT, INCLUDING
ITS LOCATION, THE LAND AREA INVOLVED AND THE NATURE OF
THE PROPOSED DEVELOPMENT OR CONSTRUCTION;
(2) A LISTING OF THE STATE AND LOCAL
AGENCIES WHICH WILL PARTICIPATE IN THE HEARING AND THEIR
POST OFFICE ADDRESSES AND TELEPHONE NUMBERS;
(3) A DESCRIPTION OF EACH PERMIT REQUESTED;
(4) THE TIME, PLACE, AND DATE OF THE
HEARING; AND
(5) IF THE HEARING IS A JOINT HEARING WITH A
LOCAL GOVERNMENT, OR AN AGENCY OF THE FEDERAL GOVERNMENT
