Section 8—403(a)
Annotated Code of Maryland
(1974 Volume and 1974 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That [[Sections 8-403(a) and 8-406]] Section
8—403(a) of Article — Natural Resources, of the Annotated
Code of Maryland (1974 Volume and 1974 Supplement) be and
they are hereby repealed and re—enacted, with amendments,
to read as follows:

8-403.
(a) A Scenic Rivers Review Board is created and
continued. The board consists of the Secretary of the
department, the Secretary of the Department of State
Planning, THE SECRETARY OF THE DEPARTMENT OF AGRICULTURE,
[[THE CHAIRMAN OF THE STATE SOIL CONSERVATION COMMITTEE,
THE CHAIRMAN OF THE MARYLAND AGRICULTURAL COMMISSION,]]
and the chairman of the Maryland Environmental Trust.
The members of the board shall select the chairman. A
member of the board may not receive any compensation for
his services but shall be reimbursed for necessary travel
expenses and disbursements made in order to attend any
meeting or perform any other official duty.

(A) A dam or other structure impeding the natural
flow of a scenic river may not be constructed, operated,
or maintained in a scenic river, and channelization may
not be undertaken, unless the Secretary specifically
approves.
(B) A SMALL POND IS EXEMPT FROM THE REQUIREMENT OF
THIS SECTION IF APPROVED BY THE APPROPRIATE SOIL
CONSERVATION DISTRICT AS PROVIDED UNDER SECTION 8-803(B).
AGRICULTURE DRAINAGE SYSTEMS ARE EXEMPT IF:
(1) APPROVED BY THE APPROPRIATE SOIL
CONSERVATION DISTRICT; AND
(2) THE CONTRIBUTORY DRAINAGE AREA DOES NOT
EXCEED 2,500 ACRES.]]
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
