BY repealing and re—enacting, with amendments,
Article 89B - State Roads
Section 33, 34 and 2116-1
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 33, 34 and 2116-1 of Article 89B
— State Roads, of the Annotated Code of Maryland (1969
Replacement Volume and 1974 Supplement) be and they are
hereby repealed and re-enacted, with amendments, to read
as follows:
Article 89B — State Roads
33.
The moneys distributed to Baltimore City under the
provisions of § 38A shall be used (1) for the
construction, reconstruction or maintenance of the
streets and highways of the City of Baltimore, (2) to pay
the costs of the Baltimore City police department for
carrying out traffic functions and enforcing the traffic
laws; (3) to pay the costs incurred in other highway
related activities of such City in lighting highways,
providing for storm water drainage of said highways, and
providing for street cleaning not to include the cost of
collection of garbage, trash and refuse; [and] (4) for
the payment of debt service with respect to bonds or
other evidences of debt heretofore or hereafter issued by
the City of Baltimore for the construction,
reconstruction or maintenance of streets and highways in
the City of Baltimore, and for other highway activities
of such City including the cost of lighting of the
highways and the cost of providing storm water drainage;
[, and for no other purposes] AND (5) TO FINANCE THE COST
OF TRANSPORTATION FACILITIES AS DEFINED IN SECTION 1 OF
ARTICLE 94A, AND FOR NO OTHER PURPOSES. The City of
Baltimore shall annually furnish to the Governor and to
the State [Roads Commission] HIGHWAY ADMINISTRATION not
later than January 1 of each year an accounting report
showing the actual costs of the preceding fiscal year and
the expenditure budget of the current fiscal year
designed to allow an accurate identification of those
portions of the cost of the Baltimore City police
department which are directly attributable to police
