[Ch. 464

ANY, FOR THAT SERVICE; AND

(5) PROVIDES ANY ADDITIONAL INFORMATION THAT
MAY BE REQUIRED BY FEDERAL LAW.

(C)     THE CURRENT PRESCRIPTION PRICE OF THE LIST OF
THE 100 MOST COMMONLY PRESCRIBED DRUGS , EXCLUDING
CONTROLLED DANGEROUS SUBSTANCES. IN THE STRENGTH AND
QUANTITY LISTED SHALL BE POSTED ON THE CHART BY EACH
PHARMACY. EACH PHARMACY SHALL DESIGNATE CLEARLY WHICH OF
THE PROFESSIONAL AND CONVENIENCE SERVICES IT MAKES
AVAILABLE. IF THE PHARMACY HAS AN ADDITIONAL CHARGE FOR
ANY PROFESSIONAL OR CONVENIENCE SERVICE, THAT ADDITIONAL
CHARGE SHALL BE DISCLOSED SEPARATELY.

(D)     THE COMPLETED CHART SHALL BE DISPLAYED
PROMINENTLY IN THE IMMEDIATE VICINITY OF THE PRESCRIPTION
DRUG SERVICE AREA IN SUCH A MANNER AS TO BE EASILY
VISIBLE TO CUSTOMERS WITHOUT HAVING TO OBTAIN PERMISSION
OR ASSISTANCE OF AN EMPLOYEE OF THE ESTABLISHMENT IN
WHICH THE PHARMACY IS LOCATED.

(E)    A PHARMACIST MAY CONVEY ORALLY, UPON REQUEST,
THE CURRENT PRESCRIPTION PRICE OF ANY PRESCRIPTION DRUG,
WHETHER APPEARING ON THE LIST OR NOT.

(F)    ANY PHARMACY MAY CHANGE A PRESCRIPTION PRICE
AT ANY TIME PROVIDED THAT THE DISPLAYED PRICE IS ADJUSTED
SIMULTANEOUSLY TO REFLECT THE NEW CURRENT PRICE.

(G) THE MARYLAND BOARD OF PHARMACY, AFTER
CONSULTATION WITH THE MARYLAND PHARMACEUTICAL ASSOCIATION
AND THE CONSUMER COUNCIL OF THE CONSUMER PROTECTION
DIVISION OF THE OFFICE OF THE ATTORNEY GENERAL, SHALL
PROMULGATE RULES AND REGULATIONS IN IMPLEMENTATION OF
THIS SECTION, INCLUDING BUT NOT LIMITED TO THE SIZE AND
FORMAT OF THE CHARTS, DETAILS AS TO STRENGTH AND
QUANTITY, AND METHODS OF DISPLAY.

(H) ANY PERSON WHO WILLFULLY VIOLATES ANY
PROVISION OF THIS SECTION IS SUBJECT TO A FINE OF NOT
MORE THAN $100 FOR EACH VIOLATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
