AS ACT concerning
County Water and Sewer Plans — Approved
FOR the purpose of providing that multi—use systems are
included in the provisions of this subsection and
allowing exceptions to the prohibition against
installation of facilities not consistent with the
county plan in a certain county under certain
conditions.
BY repealing and re—enacting, with amendments,
Article 43 - Health
Section 387C(d)(2)
Annotated Code of Maryland
(1971 Replacement Volume and 1974 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 387C(d)(2) of Article 43 - Health,
of the Annotated Code of Maryland (1971 Replacement
Volume and 1974 Supplement) be and it is hereby repealed
and re—enacted, with amendments, to read as follows:

387C.
(d) (2) The county plan, amendment, or revision
there of shall become effective immediately upon approval
by the approving authority subject to revision or other
appropriate action by the Secretary and no community
water supply, sewerage or solid waste disposal system, OR
MULTI-USE WATER SUPPLY AID SEWERAGE DISPOSAL SYSTEM, or
individual water supply or individual sewerage system or
solid waste acceptance facility may be installed or
extended in any geographic area to which said county
plan, amendment, or revision thereof relates, unless it
is in accordance therewith. [[THE APPROVING AUTHORITY,
WITH THE APPROVAL OF THE SECRETARY, MAY GRANT EXCEPTIONS
TO THE PROVISIONS OF THIS SUBSECTION.]] IN BALTIMORE
COUNTY, EXCEPTIONS ALLOWING THE INSTALLATION OF
INDIVIDUAL WATER SUPPLIES OR INDIVIDUAL SEWERAGE SYSTEMS
TO SERVE AN INDIVIDUAL RESIDENCE, MAY BE GRANTED BY THE
APPROVING AUTHORITY UPON APPROVAL OF THE SECRETARY OF
HEALTH AND MENTAL HYGIENE, PROVIDED THE SECRETARY FINDS
THAT SUCH EXCEPTION IS JUSTIFIED AND NECESSARY TO
ALLEVIATE EXTREME HARDSHIP.
