(House Bill 418)

AN ACT concerning

Property and Money Exempt from Execution
on a Judgment

FOR the purpose of providing that the exemption of
certain property and money from execution on a
judgment may not be waived; and making this Act
effective as an Emergency Act.

BY repealing and re—enacting, with amendments,

Article — Courts and Judicial Proceedings

Section 11—504 (a)

Annotated Code of Maryland

(1974 Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 11—504(a) of Article — Courts and
Judicial Proceedings, of the Annotated Code of Maryland
(1974 Volume and 1974 Supplement) be and it is hereby
repealed and re—enacted, with amendments, to read as
follows:

Article — Courts and Judicial Proceedings

11-504.

(a) Except as provided in subsection (b) , the
following are exempt from execution on a judgment:

(1)    (I) Subject to the provisions of § 11-505,
$500 in property to be selected by the defendant, but not
more than $200 in money. [The sheriff shall obtain a
signed appraisal by a disinterested appraiser of the
property selected by the defendant. The appraisal shall
be returned with the writ.]

(II)   THE PROVISIONS OF SUBPARAGRAPH (A)(1)(I)
OF THIS SECTION MAY NOT BE WAIVED.

(III)  THE SHERIFF SHALL OBTAIN A SIGNED
APPRAISAL BY A DISINTERESTED APPRAISER OF THE PROPERTY
SELECTED BY THE DEFENDANT. THE APPRAISAL SHALL BE
RETURNED WITH THE WRIT.

(2)    (I) Money payable in the nature of
insurance, benefit, or relief in the event of sickness,
accident, injury, or death of any person, except that
