SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 189B (10) (d) of Article 43 -
Health, of the Annotated Code of Maryland (1971
Replacement Volume and 1974 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:
Article 43 — Health
189B.
A drag or device shall be deemed to be misbranded:
(10) (d) In the case of a prescription drug
MANUFACTURED AFTER JULY 1, 1976. if the label [or
information accompanying the package] AFFIXED TO THE
CONTAINER fails to show the name of the actual
manufacturer of the drug[, when the manufacturer is
different from the repackager or distributor; however, in
the event a prescription drug is manufactured or
fabricated by one company pursuant to the specifications
of another company and the latter company accepts full
responsibility for the integrity of the product, only the
name of the company assuming responsibility need appear
on the label, provided a statement is filed with the
Department of Health and Mental Hygiene disclosing the
name of the manufacturer or fabricator].
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect [[July 1, 1975]] [[ January]] July 1,
1976.
