AN ACT concerning
Filing Fees For Elections — Indigency
FOR the purpose of providing for the waiver of any filing
fee required by Article 33 if the candidate
establishes his inability to pay the required fee by
filing, with his certificate of candidacy, certain
documents which establish the candidate's financial
status ([and the seriousness of his candidacy]];
and; providing for an investigation of the
candidate's financial status if the circumstances
warrant an investigation[[; providing for the form
of the petition required; and establishing certain
provisions for those who seek a nomination by means
of petition]].

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 4A—6 (g) be and it is hereby
added to Article 33 - Election Code, of the Annotated
Code of Maryland (1971 Replacement Volume and 1974
Supplement) to read as follows:
Article 33 — Election Code
4A-6.
(6) (1) EACH FILING FEE REQUIRED BY THIS SECTION OR
BY SECTION 7-1 IS MANDATORY UNLESS THE CANDIDATE
ESTABLISHES HIS INABILITY TO PAY THE FEE. THE FEE SHALL
BE WAIVED IF THE CANDIDATE ESTABLISHES HIS INABILITY TO
PAY [[AND THE SERIOUSNESS OF HIS CANDIDACY]] BY ATTACHING
TO THE CERTIFICATE OF CANDIDACY, AT THE TIME AND PLACE OF
FILING THE CERTIFICATE, A SWORN STATEMENT OF INABILITY TO
PAY WHICH__SHALL SET FORTH THE NATURE, EXTENT AND
LIQUIDITY OF THE CANDIDATE'S ASSETS AND THE DISPOSABLE
NET INCOME OF THE CANDIDATE. THE BOARD WITH WHICH THE
CERTIFICATE OF CANDIDACY IS FILED MAY CONDUCT AN
INVESTIGATION OF THE CANDIDATE'S FINANCIAL STATUS IF THE
CIRCUMSTANCES SO WARRANT. [[THE FOLLOWING MATERIALS:
(I) A SWORN STATEMENT OF INABILITY TO PAY
