AN ACT concerning
Chesapeake Bay — Dumping
FOR the purpose of requiring the [[Departments of Health
and Mental Hygiene and Natural Resources to inspect
certain areas before and during the dumping of
certain substances in them; making available the
results of those inspections; and requiring that the
dumping be terminated under certain circumstances]].
Department of Natural Resources in cooperation with
other appropriate agencies to monitor and evaluate
certain dredge spoil operations at certain times and
making monitoring data available to the public.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 8—1413.1 be and it is hereby
added to Article — Natural Resources, of the Annotated
Code of Maryland (1974 Volume and 1974 Supplement) to
read as follows:
Article — Natural Resources
8-1413.1.
[[ANY PERSON OR STATE AGENCY WHO PROPOSES TO DUMP,
DEPOSIT, OR SCATTER SOIL, WASTE MATTER, MOCK, OR ANY
OTHER SUBSTANCE DETRIMENTAL TO MARINE LIFE ANYWHERE IN
THE CHESAPEAKE BAY AND ITS TRIBUTARIES, INCLUDING RIVER
BOTTOMS AND BAYS, SHALL NOTIFY THE SECRETARY OF HEALTH
AND MENTAL HYGIENE AND THE SECRETARY OF NATURAL RESOURCES
AT LEAST TWO WEEKS IN ADVANCE. THE SECRETARIES SHALL
INSPECT THE AREA BEFORE THE DUMPING, DEPOSITING, OR
SCATTERING BEGINS, AND THEN TWICE WEEKLY FOR AS LONG AS
IT CONTINUES. THE SECRETARIES SHALL MAKE AVAILABLE
PROMPTLY TO ANYONE WHO REQUESTS IT ANY DATA RELATING TO
THE ENVIRONMENTAL IMPACT OF THE DUMPING, DEPOSITING, OR
SCATTERING. IF SUBSTANCES DETRIMENTAL TO MARINE LIFE ARE
TRACED TO THE DUMPING, IT SHALL BE TERMINATED
IMMEDIATELY. ]] THE DEPARTMENT IN COOPERATION WITH OTHER
APPROPRIATE AGENCIES, SHALL EVALUATE AND MONITOR THE
