regulation, qualifications for licensing AND
CERTIFICATION in each category established by § 5-207 to
assure competence and responsibility in the application
of pesticides. [In establishing these qualifications the
Secretary shall consider formal education in entomology
and pest control, as well as practical experience.]

(b)    The Secretary may issue licenses AND
CERTIFICATES only to an applicant who meets the
requirements established by the Department.

(c)  The Secretary may establish the conditions under
which licenses AND CERTIFICATES may be revoked OR
SUSPENDED.

(d)  The Secretary may establish minimum requirements
for financial responsibility for all damages which may be
incurred in the commercial application of pesticides.

5-207.

(a)      Each custom applicator, pest control
consultant, [and] pest control [operator] APPLICATOR, AND
PUBLIC AGENCY APPLICATOR shall obtain an annual [license]
CERTIFICATE INDICATING COMPETENCE IN ONE OR MORE
ESTABLISHED CATEGORIES from the Secretary [,]. EACH
PRIVATE APPLICATOR SHALL OBTAIN A CERTIFICATE WHICH SHALL
REQUIRE PERIODIC RENEWAL AS DETERMINED BY THE SECRETARY
[unless he is exempt by § 5-208].

(b)   [[ [ ]]Each application FOR A CERTIFICATE BY A
PEST CONTROL CONSULTANT, PEST CONTROL APPLICATOR, AND
CUSTOM APPLICATOR shall be accompanied by a [[$30 license
fee and evidence of financial responsibility as required
by the Secretary.[[ ] ]] FEES FOR CERTIFICATES FOR PEST
CONTROL CONSULTANTS, PEST CONTROL APPLICATORS, CUSTOM
APPLICATORS AND PRIVATE APPLICATORS SHALL BE REASONABLE
AND DETERMINED BY THE SECRETARY]] $50 CERTIFICATE FEE
PLUS $25 FOR EACH CATEGORY IN EXCESS OF ONE. EACH
APPLICATION FOR A PRIVATE [[APPLICATORS]] APPLICATOR'S
CERTIFICATE SHALL BE ACCOMPANIED BY A FEE TO BE SET BY
THE SECRETARY, BUT NOT TO EXCEED $7.

(c)   Each applicant shall demonstrate his competence
to use and apply pesticides safely in the State by
passing a written or oral examination prepared and
administered by the Department [.]; THERE SHALL BE NO
CHARGE FOR AN INITIAL EXAMINATION, PROVIDED THAT PEST
CONTROL APPLICATORS, PEST CONTROL CONSULTANTS AND CUSTOM
APPLICATORS SHALL PAY $10 FOR EACH CATEGORY OF
EXAMINATION AFTER THE INITIAL EXAMINATION.

(d)  [Once granted, each license] EACH CERTIFICATE
shall be renewed [annually] upon payment of the [license]
