COMMISSIONER, IN A SUIT, ACTION, OR PROCEEDING INSTITUTED
BY HIM, IMMEDIATELY SENDS NOTICE OF THE SERVICE AND A
COPY OF THE PROCESS BY REGISTERED MAIL TO THE DEFENDANT
OR RESPONDENT AT HIS LAST KNOWN ADDRESS OR TARES OTHER
STEPS WHICH ARE REASONABLY CALCULATED TO GIVE ACTUAL
NOTICE; AND

(II) THE PLAINTIFF'S AFFIDAVIT OF COMPLIANCE
WITH THIS SECTION IS FILED IN THE CASE ON OR BEFORE THE
RETURN DAY OF THE PROCESS, IF ANY, OR WITHIN ANY FURTHER
TIME THE COURT ALLOWS.

(C) CONTINUANCE.

WHEN PROCESS IS SERVED UNDER THIS SECTION, THE COURT
OR THE COMMISSIONER IN A PROCEEDING BEFORE HIM, SHALL
ORDER THE CONTINUANCE NECESSARY TO AFFORD THE DEFENDANT
OR RESPONDENT REASONABLE OPPORTUNITY TO DEFEND.

REVISOR'S NOTE; This section presently appears as
Art. 32A, §38(g) through (i).

The tern "personal representative" is
substituted for "executor, or administrator."
In this regard, see Art. 1, §5 of the Code.

The only other changes are technical changes
in style.

11-803. SECURITIES SOLD OR DISPOSED OF BEFORE JUNE 1,
1962.

ANY SECURITY WHICH, BEFORE OR WITHIN 90 DAYS AFTER
JUNE 1, 1962, HAS BEEN SOLD OR DISPOSED OF BY THE ISSUER
OR BONA FIDE OFFERED TO THE PUBLIC IS EXEMPT FROM THE
REGISTRATION PROVISIONS OF THIS TITLE, BUT THIS
EXEMPTION DOES NOT APPLY TO ANY NEW OFFERING OF THE
SECURITY BY AN ISSUER OR UNDERWRITER SUBSEQUENT TO THE
90-DAY PERIOD.

REVISOR'S NOTE: This section presently appears as
Art. 32A, §40.

Present §40 (a) and (b), which are
transitional provisions, are deleted as
obsolete.

The only other changes are technical changes
in style.

11-804. UNIFORMITY OF INTERPRETATION.

THIS TITLE SHALL BE CONSTRUED TO EFFECTUATE ITS
GENERAL PURPOSE TO MAKE UNIFORM THE LAW OF THOSE STATES
