[[licensure]] license requirements or shows that it will
meet all [[licensure]] license requirements by the time
the sprinkler system ,__including water supplies, or other
improvement is installed. The application shall be made
to the Department of Health and Mental Hygiene and shall
include the plans for installing the hydraulic sprinkler
system or other life safety improvements.
(5) Upon approving the plans and determining that
the domiciliary care facility meets the license
requirements provided by the subtitle "Hospitals and
Related Institutions" of Article 43 of the Annotated Code
of Maryland and the rules and regulations of the
Secretary of Health and Mental Hygiene, the Department of
Health and Mental Hygiene shall send the application for
a loan to the Board of Public Works and recommend that
the necessary loan be granted as provided by this Act.
(6) The Board of Public Works shall make loans as
follows:
(A) A total aggregate amount of up to [[Ten
Thousand Dollars ($10,000)]] Twenty Thousand Dollars
($20,000) shall be loaned to any domiciliary care
facility for the installation of a hydraulic sprinkler
system , including water supplies, and any other life
safety improvements required to be installed in the
domiciliary care facility by the Department of Health and
Mental Hygiene. The loan will be repaid to the State by
the domiciliary care facility within fifteen (15) years
after the loan is made.
(B) The loan shall be repaid at a rate of
interest, to be determined by the Board of Public Works,
which shall reimburse the State for all costs [[incurred
in the administration]] of the loan program.
(C) Loans shall be made without prejudice to
both proprietary and nonprofit applicants.
(7) The Board of Public Works is authorized to
adopt rules and regulations for receiving and considering
applications under and making loans to domiciliary care
facilities.
(8) No loans [[may]] shall be granted until the
Department of Health and Mental Hygiene and the
Commission on the Aging presents a comprehensive plan for
the delivery of domiciliary care services to the
Department of State Planning for review prior to approval
by the Board of Public Works. The plan must be developed
in coordination with the Department of Public Safety and
Correctional Services, the Department of Employment and
Social Services, the Department of Budget and Fiscal
