procedures; providing that the exemption from the
registration requirements for certain aircraft owned
and operated by an air carrier certified by or
operating pursuant to certain exemption authority
shall apply only if the aircraft are used
exclusively for the purposes for which the exemption
was granted; and making certain changes in style.
BY repealing and re-enacting, with amendments,
Article 1A — Aviation
Section 6—601(c) and (g)
Annotated Code of Maryland
(1968 Replacement Volume and 1974 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 6-601(c) and (g) of Article 1A -
Aviation, of the Annotated Code of Maryland (1968
Replacement Volume and 1974 Supplement) be and they are
hereby repealed and re—enacted, with amendments, to read
as follows:
Article 1A — Aviation
6-601.
(c) within 24 hours after the sale of a registered
aircraft, the purchaser [thereof] shall return to the
Administration the registration certificate of [such] THE
aircraft, together with the date and place of sale or
transfer, and his name and address or residence, and
shall simultaneously apply for the transfer of the
registration certificate. The fee for transfer of the
registration certificate shall be [one dollar ($1.00).]
$1. However, if the purchaser of an aircraft registered
in Maryland is a nonresident, the seller is required to
fulfill the requirements of this section. IF THE
AIRCRAFT IS TO BE REMOVED FROM THE STATE, OR IS OTHERWISE
MADE EXEMPT FROM REGISTRATION UNDER THE PROVISIONS OF
THIS ARTICLE AS A RESULT OF THE SALE OR AT THE OPTION OF
THE SELLER, THE SELLER MAY APPLY FOR A TRANSFER OF THE
REGISTRATION CERTIFICATE OF HIS FORMER AIRCRAFT TO
ANOTHER AIRCRAFT. APPLICATION SHALL BE MADE WITHIN 30
DAYS FOLLOWING THE DATE OF SALE OF THE AIRCRAFT AND SHALL
BE ACCOMPANIED BY A TRANSFER FEE NOT TO EXCEED $10 AND
PROOF OF DESTRUCTION OF THE FORMER REGISTRATION STICKER.
THE OWNER SHALL PAY THE DIFFERENCE, IF ANY, BETWEEN THE
REGISTRATION FEE FOR HIS FORMER AIRCRAFT AND THE FEE FOR
THE AIRCRAFT TO WHICH THE REGISTRATION CERTIFICATE IS
TRANSFERRED, BUT NO REFUNDS SHALL BE MADE BY THE
ADMINISTRATION.
