LAWS OF MARYLAND

[Ch. 276

DISEASE, OR INJURY, THE CORRECTION OF DEFECTS OR THE
MAINTENANCE OF THE PHYSICAL AND MENTAL WELL-BEING OF
HUMAN BEINGS.

(D)    "SUBSCRIBER" MEANS A PERSON WHO HAS ENTERED
INTO A CONTRACTUAL ARRANGEMENT WITH A HEALTH MAINTENANCE
ORGANIZATION, EITHER DIRECTLY OR THROUGH AN INSURER OR
MARKETING ORGANIZATION, UNDER WHICH THE PERSON AND/OR
OTHER DESIGNATED PERSONS ARE ENTITLED TO RECEIVE THE
HEALTH CARE SERVICES CONTRACTED FOR.

(E)    "MEMBER" (WHO MAY BE REFERRED TO AS
"ENROLLEE") MEANS A PERSON WHO HAS ENTERED INTO A
CONTRACTUAL ARRANGEMENT OR ON WHOSE BEHALF A CONTRACTUAL
ARRANGEMENT HAS BEEN ENTERED INTO WITH A HEALTH
MAINTENANCE ORGANIZATION FOR HEALTH CARE SERVICES.

(F)    "PERSON" MEANS ANY INDIVIDUAL, PARTNERSHIP,
ASSOCIATION, CORPORATION, OR OTHER LEGAL ENTITY.

(G)    "HEALTH CARE PLAN" (WHICH MAY BE REFERRED TO
AS A "BENEFIT PACKAGE") MEANS THE ARRANGEMENT THROUGH
WHICH HEALTH CARE SERVICES ARE PROVIDED TO A MEMBER UNDER
CONTRACTS WHICH ENTITLE THE MEMBER TO THE HEALTH CARE
SERVICES PROVIDED DIRECTLY, OR FURNISHED THROUGH
CONTRACTS OR ARRANGEMENTS WITH OTHER PERSONS, BY A HEALTH
MAINTENANCE ORGANIZATION.

[[(H) "PROVIDER" MEANS ANY PHYSICIAN, HOSPITAL, OR

OTHER INSTITUTION, ORGANIZATION, OR PERSON THAT FURNISHES

HEALTH CARE SERVICES WHO IS LICENSED OR OTHERWISE
AUTHORIZED TO PRACTICE IN THE STATE.]]

(H) "PROVIDER" MEANS ANY PHYSICIAN, HOSPITAL, OR
OTHER INSTITUTION. ORGANIZATION OR PERSON WHICH IS
LICENSED OR OTHERWISE AUTHORIZED IN THE STATE TO FURNISH
HEALTH CARE SERVICES.

(A)    ON AND AFTER JANUARY 1, 1976, NO HEALTH
MAINTENANCE ORGANIZATION MAY OPERATE WITHOUT THE
AUTHORIZATION OF THE COMMISSIONER. THE COMMISSIONER.
WITH THE ADVICE OF THE DEPARTMENT OF HEALTH AND MENTAL
HYGIENE, SHALL PROMULGATE REASONABLE RULES AND
REGULATIONS AS NECESSARY FOR THE PROPER ADMINISTRATION OF
THIS SUBTITLE.

(B)    A HEALTH MAINTENANCE ORGANIZATION MUST APPLY
FOR A CERTIFICATE OF AUTHORITY FROM THE COMMISSIONER TO
OPERATE AS A HEALTH MAINTENANCE ORGANIZATION AND UNDER
THE CERTIFICATE SHALL BE REGULATED PURSUANT TO THE
PROVISIONS OF THIS SUBTITLE.
