LAWS OF MARYLAND

[Ch. 263

(B) STATE AID - 1979-80 AND AFTER. FOR THE SCHOOL
YEAR 1979-80 AND THEREAFTER, EACH COUNTY BOARD OF
EDUCATION SHALL RECEIVE FROM THE STATE, IN THE MANNER AND
SUBJECT TO THE LIMITATIONS EXPRESSED IN THIS SECTION, AN
AMOUNT TO BE KNOWN AS THE STATE SHARE OF BASIC SPECIAL
EDUCATIONAL EXPENSES, WHICH, FOR EACH COUNTY, SHALL BE
CALCULATED AS FOLLOWS:

(1)    BASIC SPECIAL EDUCATIONAL EXPENSES TO BE
SHARED. THE STATE SHALL SHARE IN AN EXPENDITURE FOR
BASIC SPECIAL EDUCATIONAL EXPENSES OF $135 MULTIPLIED BY
THE NUMBER OF PUPILS ENROLLED, AS DEFINED IN SUBSECTION
(A)(2) OF THIS SECTION.

(2)    COUNTY SHARE. TO BE ELIGIBLE TO RECEIVE
THE STATE SHARE OF BASIC SPECIAL EDUCATIONAL EXPENSES,
THE COUNTY GOVERNING BODY SHALL LEVY AN ANNUAL TAX
SUFFICIENT TO PROVIDE AN AMOUNT OF REVENUE FOR SPECIAL
EDUCATIONAL SERVICES EQUAL TO THE PRODUCT OF THE WEALTH
OF THE COUNTY, AS DEFINED IN SUBSECTION (A)(2) OF THIS
SECTION, AND A UNIFORM PERCENTAGE DETERMINED FOR EACH
FISCAL YEAR AS FOLLOWS: THE SUM OF THE BASIC SPECIAL
EDUCATIONAL EXPENSES TO BE SHARED FOR ALL OF THE COUNTIES
SHALL BE MULTIPLIED BY 0.45. THE PRODUCT SHALL THEN BE
DIVIDED BY THE SUM OF THE WEALTH OF ALL OF THE COUNTIES;
AND THE RESULTING QUOTIENT, EXPRESSED AS A PERCENTAGE
ROUNDED TO THE THIRD DECIMAL PLACE, SHALL BE THE UNIFORM
PERCENTAGE. IN NO EVENT, HOWEVER, SHALL A COUNTY
CONTRIBUTE LESS TO THIS PROGRAM THAN IT DID IN THE SCHOOL
YEAR 1975-76.

(3)    STATE SHARE. THE STATE SHARE OF BASIC
SPECIAL EDUCATIONAL EXPENSES FOR EACH COUNTY SHALL BE THE
DIFFERENCE BETWEEN THE COUNTY SHARE CALCULATED PURSUANT
TO SUBSECTION (B) (2) AND THE BASIC CURRENT EXPENSE TO BE
SHARED, AS DEFINED IN SUBSECTION (B)(1).

(4)    MINIMUM GUARANTEE. NOTWITHSTANDING THE
PROVISIONS OF PARAGRAPHS (2) AND (3), EACH COUNTY SHALL
RECEIVE, AS THE STATE SHARE OF BASIC SPECIAL EDUCATIONAL
EXPENSES, A MINIMUM AMOUNT CALCULATED BY MULTIPLYING THE
AMOUNT OF STATE AID PER PUPIL ENROLLED THE COUNTY
RECEIVED FOR SPECIAL EDUCATION, EXCLUDING DENSITY AID
UNDER §128B OF THIS ARTICLE AND TRANSPORTATION AID UNDER
§99 OF THIS ARTICLE, FOR FISCAL YEAR 1975 BY 150%, AND
THEN MULTIPLYING THE PRODUCT BY THE NUMBER OF PUPILS
ENROLLED FOR THE CURRENT YEAR. ANY ADDITIONAL AMOUNT OF
STATE AID PAYABLE BY VIRTUE OF THIS PARAGRAPH SHALL NOT
AFFECT THE REQUIRED COUNTY SHARE UNDER PARAGRAPH (2), BUT
SHALL BE DEEMED ADDITIONAL AID TO BE USED SOLELY FOR
SPECIAL EDUCATIONAL SERVICES.

(C) STATE AID - 1976-77 THROUGH 1978-79. FOR THE
SCHOOL YEARS 1976-77 TO AND INCLUDING 1978-79, THE STATE
