[[4. NUTRITIONAL PROGRAM FOR THE ELDERLY

(A)    IN ESTABLISHING THE NUTRITIONAL PROGRAM FOR
THE ELDERLY, THE DIRECTOR SHALL PRESENT THE PLAN FOR THE
PROGRAM TO THE SECRETARY OF HEALTH, EDUCATION AND WELFARE
FOR APPROVAL OF A GRANT OF 90 PERCENT OF THE TOTAL
PROGRAM FUNDS UNDER THE FEDERAL NUTRITIONAL PROGRAM FOR
THE ELDERLY. THE OFFICE MAY INCLUDE IN ITS ANNUAL BUDGET
AN AMOUNT, TO BE FUNDED FROM THE GENERAL FUNDS OF THE
STATE, OF NOT MORE THAN 10 PERCENT OF THE TOTAL PROGRAM
COST, WHICH SHALL REPRESENT THE NON-FEDERAL SHARE OF THE
NUTRITION PROGRAM.

(B)     THE NUTRITIONAL PROGRAM FOR THE ELDERLY SHALL
PROVIDE ELDERLY PERSONS WITH LOW COST, NUTRITIONALLY
SOUND HEALS SERVED IN CENTRALLY LOCATED FACILITIES SUCH
AS SCHOOLS, CHURCHES, COMMUNITY CENTERS, AND OTHER PUBLIC
OR PRIVATE NONPROFIT INSTITUTIONS.

(C)     THE DIRECTOR SHALL PROVIDE CONSULTATIVE
SERVICES AND TECHNICAL ASSISTANCE TO ANY PUBLIC OR
PRIVATE NONPROFIT ORGANIZATION OR AGENCY INCLUDED IN THE
PROGRAM. HE SHALL PROVIDE SHORT-TERM TRAINING AND
TECHNICAL INSTRUCTION TO THESE ORGANIZATIONS, AND
COLLECT, PREPARE, PUBLISH, AND DISSEMINATE SPECIAL
EDUCATIONAL OR INFORMATIONAL MATERIAL RELATING TO THE
PROGRAM. THE DIRECTOR MAY REIMBURSE THESE ORGANIZATIONS
FOR ANY FUNDS EXPENDED IN CARRYING OUT THE PURPOSES OF
THE PROGRAM.

(D)     PERSONS RECEIVING SERVICES UNDER THE PROGRAM
MAY BE CHARGED FOR MEALS, TAKING INTO ACCOUNT
CONSIDERATIONS AS INCOME AND NEED. HOME DELIVERY OF
MEALS MAY BE INCLUDED WITHIN THE PROGRAM IF THE
CIRCUMSTANCES REQUIRE THIS SERVICE.]]

[[5]] 4. NURSING HOMES

(A)     THE DIRECTOR OK AGING MAY]] SHALL RECEIVE
AND INVESTIGATE COMPLAINTS CONCERNING THE OPERATIONS OF
RELATED INSTITUTIONS, AS DEFINED IN §556 (D) OF ARTICLE
43, AND HE MAY, ON HIS OWN MOTION, MAKE ON-SITE VISITS TO
DETERMINE IF THESE INSTITUTIONS ARE IN COMPLIANCE WITH
APPLICABLE LAWS, RULES, AND REGULATIONS.

(B)     IF THE DIRECTOR ON AGING FINDS THAT ANY SUCH
RELATED INSTITUTION IS IN VIOLATION OF ANY STATUTE, RULE,
OR REGULATION OF ANY STATE AGENCY WHICH IS DIRECTLY AND
SPECIFICALLY CHARGED WITH THE REGULATIONS OF ANY ASPECT
OF THE INSTITUTION, HE OR SHE SHALL IMMEDIATELY NOTIFY
THAT AGENCY IN WRITING OF [[HIS]] THE FINDINGS OF FACT.
IF THE VIOLATION OR CONDITION IS NOT CORRECTED WITHIN A
REASONABLE TIME, THE DIRECTOR SHALL, WITH THE PRIOR
APPROVAL OF THE COMMISSION, [[ORDER]] REQUEST THE STATE
