§ 5. Commission to establish and administer

program; conformity to federal act; presentation to
Secretary of Health, Education and Welfare; inclusion of
item in Commission's budget.

The Maryland Commission on Aging shall establish and
administer a nutritional program for the elderly, which
shall conform to the provisions of Title 7 of the Federal
Older Americans Act of 1965. The Commission shall
present the plan for the program to the Secretary of
Health, Education and Welfare for approval for a grant of
90% of the total program funds under the federal
nutritional program for the elderly. The Commission may
include in its annual budget an amount, to be funded from
the general funds of the State, of not more than 10% of
the total program cost, which shall represent the
nonfederal share of the nutrition program.

§ 6. Purpose of program; duties of Commission
toward agencies included in program; charge for meals;
home delivery.

(a) The nutritional program for the elderly shall
provide elderly persons, with low cost, nutritionally
sound meals served in centrally located facilities such
as schools, churches, community centers, and other public
or private nonprofit institutions.

(b)   The commission shall provide consultative
services and technical assistance to any public or
private nonprofit organization or agency included in the
program; provide short—term training and technical
instruction to these organizations; and collect, prepare.
publish and disseminate special educational or
informational material on this matter. The Commission may
reimburse these organizations for any funds expended in
carrying out the purposes of the program.

(c)  Persons receiving services under the program may
be charged for meals, taking into account such
considerations as income and need. Home delivery of
meals may be included within the program if the
circumstances require this service.]

SECTION 2. AND BE IT FURTHER ENACTED, That new
Article 70B — Office on Aging, Sections 1 through [[6]]
5, be and it is hereby added to the Annotated Code of
Maryland (1970 Replacement Volume and 1974 Supplement) to
read as follows:
