SECTION 9. AND BE IT FURTHER ENACTED, That Sections
4A-1 (a) and 8-2(a) of Article 33 - Election Code, of the
Annotated Code of Maryland (1971 Replacement Volume and
1974 Supplement) be and they are hereby repealed and
re—enacted, with amendments, to read as follows:

Article 33 — Election Code

4A-1.

(a) Each person seeking nomination to any public
or party office at a primary election, shall file a
certificate of candidacy for nomination in the manner and
at the time provided in this subtitle. Such person who
is a candidate for any State, local, or party office must
be a registered voter of the particular county or
district in which he seeks to be nominated. A candidate
for any federal. State, local or party office shall be
affiliated with the party whose office he seeks. Before
finally placing the name of such a candidate on the
ballot at the succeeding primary election, the board
shall determine that the candidate meets the registration
and affiliation requirements of this section. The
requirements of this section shall not apply to the party
affiliation of any candidate for judicial office OR FOR
THE OFFICE OF STATE PROSECUTOR for which candidates are
permitted to be listed on the ballot without party
designation; but the requirements shall be applicable to
the filling of any vacancy in any public or party office.

8-2.

(a) No person who has been defeated for the
nomination for any office in a primary election, except a
candidate for the office of judge OR FOR THE OFFICE OF
STATE PROSECUTOR, and except as provided in subsection
(b) below, shall have his name printed on the ballot at
the succeeding general election as a candidate for any
office. Nothing in this subsection shall be interpreted
as being applicable to candidates for nomination of their
party for President of the United States who have been
defeated in a Presidential preference primary election.

SECTION 10. AND BE IT FURTHER ENACTED, That new
Sections 8-501 through 8-505 to be under the new subtitle
"Subtitle 5. Special Grand Jury" be and they are hereby
added to Article — Courts and Judicial Proceedings, of
the Annotated Code of Maryland (1974 Volume and 1974
Supplement) to read as follows:
