LAWS OF MARYLAND

[Ch. 255

(A)     THE COMMISSION SHALL ADOPT RULES OF PROCEDURE
FOR THE IMPLEMENTATION OF ITS POWERS UNDER ARTICLE V,
SECTION 12(B) OF THE CONSTITUTION OF MARYLAND, AND IT MAY
EMPLOY SUCH STAFF AS IS PROVIDED IN THE STATE BUDGET.

(B)    ALL PROCEEDINGS, TESTIMONY, AND OTHER EVIDENCE
BEFORE THE COMMISSION ARE CONFIDENTIAL AND PRIVILEGED.
HOWEVER,

(1)    THE RECORD OF ANY PROCEEDING FILED WITH
THE COURT OF APPEALS LOSES ITS CONFIDENTIAL AND
PRIVILEGED STATUS, EXCEPT AS ORDERED BY THE COURT; AND

(2)    IF THE ORDER OF THE COMMISSION IS TO
DISMISS THE PROCEEDINGS WITHOUT TAKING ACTION OR TO ISSUE
A REPRIMAND, IT MAY MAKE THE ORDER, PROCEEDINGS,
TESTIMONY, AND EVIDENCE PUBLIC.

SECTION 3. AND BE IT FURTHER ENACTED, That new
Sections 33G and 33H to be under the new subtitle
"Prosecutors Selection Commission" be and they are hereby
added to Article 10 — Attorneys at Law and Attorneys in
Fact, of the Annotated Code of Maryland (1968 Replacement
Volume and 1974 Supplement) to read as follows:

PROSECUTORS SELECTION COMMISSION

33G. PROSECUTORS SELECTION COMMISSION

(A)      THE PROSECUTORS SELECTION COMMISSION IS
CREATED.

(B)    IT CONSISTS OF THE MEMBERS OF THE PROSECUTORS
DISABILITIES COMMISSION.

(C)     THE MEMBERS OF THE COMMISSION SHALL NOT
RECEIVE COMPENSATION BUT SHALL BE REIMBURSED FOR THEIR
REASONABLE EXPENSES INCURRED IN THE PERFORMANCE OF THEIR
DUTIES, AS PROVIDED IN THE STATE BUDGET.

33H. DUTIES; NOMINATION OF CHIEF STATE PROSECUTOR

(A) UPON NOTIFICATION BY THE GOVERNOR THAT A
VACANCY EXISTS OR IS ABOUT TO OCCUR IN THE OFFICE OF THE
CHIEF STATE PROSECUTOR, THE COMMISSION SHALL SEEK AND
REVIEW AMPLICATIONS OF PROPOSED NOMINEES FOR THE
POSITION. IT SHALL NOTIFY THE MARYLAND STATE BAR
ASSOCIATION, INCORPORATED, OF THE VACANCY, AND SHALL
REQUEST RECOMMENDATIONS FROM THAT ASSOCIATION. IT MAY
ALSO SEEK RECOMMENDATIONS FROM INTERESTED CITIZENS AND
FROM AMONG ITS OWN MEMBERS.
