SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 2-106(a)(5)and (b) and 11-201 and
11-205(b) of Article - Agriculture, of the Annotated Code
of Maryland (1974 Volume and 1974 Supplement) be and they
are hereby repealed and re—enacted, with amendments, to
read as follows:

Article — Agriculture

2-106.

(a)    The following positions and units are included
within the Department:

(5) The [State Superintendent] CHIEF of
Weights and Measures;

(b)    The Secretary shall appoint the State Chemist,
State Veterinarian, and [State Superintendent] CHIEF of
Weights and Measures. The Secretary shall appoint the
Inspector of Tobacco with the approval of the Governor.

The [Superintendent] CHIEF of Weights and Measures
may administer the provisions of this title under the
supervision of the Secretary.

(b) concurrent enforcement authority with local
inspector. In any city or county where a local inspector
is permitted by this subtitle, the [superintendent] CHIEF
OF WEIGHTS AND MEASURES has concurrent authority to
enforce the provisions of this title.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
