GENERAL REVISOR'S NOTE:

The Commission to Revise the Annotated Code, in
compiling Title 4 of the Estates and Trusts Article,
concluded that certain provisions of present law
originally allocated to Title 4 are repetitious,
obsolete, or more properly allocable elsewhere.
Accordingly, these provisions are embodied in Title 4.
Their proposed treatment is as follows:

SUBTITLE 1. GENERAL PROVISIONS.
5-101. SCOPE OF TITLE.
(A) APPLICATION.

THIS SUBTITLE IS APPLICABLE TO THE PORTION OF THE
PROBATE PROCEEDING WHICH RELATES TO THE PROBATE OF A
WILL, IF ANY, AND THE GRANT OF LETTERS.

(B) PROBATE OF A WILL AND GRANT OF LETTERS.

PROBATE OF A WILL, IF ANY, AND THE GRANT OF LETTERS,
MAY BE ACCOMPLISHED AFTER FILING OF A PETITION FOR
PROBATE BY:

(1)   ADMINISTRATIVE PROBATE BY THE REGISTER OF
WILLS AS DESCRIBED IN SUBTITLE 3; OR

(2)     JUDICIAL PROBATE BY THE COURT AS
DESCRIBED IN SUBTITLE 4.

REVISOR'S NOTE: This section presently appears as
Art. 93, §5-101. A subsection is added for
organizational purposes. The only other
changes are in style and language.
