SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 98D (a) of the Public Local Laws of
Allegany County being Article 1 of the Code of Public
Local Laws of Maryland (196 3 Edition and 1973 Supplement)
be and it is hereby repealed and re—enacted, with
amendments, to read as follows:
Article 1
98D.
(a) At the time of the referendum to be held by
the Board of Supervisors of Elections of Allegany County
as hereinafter provided, the owners of real property
within the special taxing district, shall also elect a
committee of five persons. Placement of a candidate's
name on the ballot shall be upon the written petition of
at least ten per cent (10%) of the registered voters
within the district on forms prepared for that purpose by
the Allegany County Board of Election Supervisors. The
election shall be held in the following manner, to wit:
one member of the committee shall be elected to serve for
one year or part thereof; ONE MEMBER SHALL BE ELECTED TO
SERVE FOR TWO YEARS OR PARTS THEREOF; ONE MEMBER SHALL BE
ELECTED TO SERVE FOR THREE YEARS OR PARTS THEREOF; ONE
MEMBER SHALL BE ELECTED TO SERVE FOR FOUR YEARS OR PARTS
THEREOF; and one member shall be elected to serve for
five years or parts thereof. The candidate receiving the
greatest number of votes in the election shall serve for
the longest term, provided that the tax district
referendum passes. The candidate receiving the next
greatest number of votes shall serve the next longest
term, and so on until all the terms are filled.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
is hereby declared to be an emergency measure and
necessary for the immediate preservation of the public
health and safety and having been passed by a yea and nay
vote supported by three—fifths of all the members elected
to each of the two Houses of the General Assembly, the
same shall take effect from the date of its passage.
