DEPOSIT OF THE PURCHASE PRICE, ALL COSTS, FEES, AND
CHARGES FOR THE VACANT LAND, AND SHALL BE FILED IN THE
ORDER RECEIVED BY THE ARCHIVIST. IN GRANTING ANY REQUEST
FOR THE PATENT, ANY PERSON OTHER THAN THE ORIGINAL
APPLICANT WHO FILED APPLICATIONS PURSUANT TO §13-106
PRIOR TO THE DATE OF THE ORDER OF TERMINATION SHALL BE
PREFERRED, IN THE ORDER OF ORIGINAL FILING, TO ANY OTHER
PERSON. IF A REQUEST IS GRANTED, THE NEW APPLICANT SHALL
BE SUBSTITUTED IN THE PROCEEDING FOR THE ORIGINAL
APPLICANT AND FURTHER NOTICE OR PROOF MAY NOT BE
REQUIRED.

(E) DEBT AND LIEN FOR UNPAID FEES.

ALL COSTS, FEES, EXPENSES, AND THE PURCHASE PRICE
FOR ANY VACANT LAND CONSTITUTES A DEBT TO THE STATE BY
THE APPLICANT OR OTHER PERSON AGAINST WHOM THE COSTS,
FEES, EXPENSES, OR PURCHASE PRICE IS PROPERLY ASSESSED
FROM THE TIKE OF THE TERMINATION OF THE PROCEEDING. NO
PATENT MAY BE ISSUED UNTIL THE COSTS, FEES, EXPENSES, AND
PURCHASE PRICE ARE PAID BY THE APPLICANT TO THE
ARCHIVIST. IF A PROCEEDING TERMINATES OTHERWISE THAN BY
ISSUANCE OF A PATENT, THE ARCHIVIST SHALL FILE A
CERTIFIED LIST OF ANY UNPAID COSTS, FEES, EXPENSES, OR
PURCHASE PRICE IN ANY COUNTY WHERE THE APPLICANT IS KNOWN
OR SUSPECTED TO OWN PROPERTY. WHEN FILED, THE DEBT
REPRESENTED BY THE LIST HAS THE FORCE AND EFFECT OF A
JUDGMENT LIEN AND MAY BE ENFORCED ACCORDINGLY.

REVISOR'S NOTE: This section presently appears as
Art. 21, §13-114 of the Code.

Subsection (c) is divided to form new
subsection (d) for organizational purposes.
New language is added to subsection (c) to
make clear the length, as provided earlier in
this title, of the period before the applicant
is in default.

The only other changes are in style.

13-117. COMPLIANCE; VESTED RIGHT OR INTEREST NOT
AFFECTED.

ANY PROCEEDING FOR THE ISSUANCE OF A PATENT AFTER
JUNE 1, 1967, SHALL BE CONDUCTED IN ACCORDANCE WITH THE
PROVISIONS OF THIS TITLE. HOWEVER, A PROCEEDING OR ANY
DETERMINATION PROVIDED IN THIS TITLE DOES NOT DESTROY OR
AFFECT ANY VESTED RIGHT OR INTEREST ACQUIRED BY ANY
PERSON UNDER A WARRANT OR CERTIFICATE OF SURVEY.
