13-102. CONSTRUCTION OF TITLE.

THIS TITLE DOES NOT ALTER, ABRIDGE, OR IN ANY MANNER
AFFECT THE RIGHTS OF ANY PERSON DERIVING TITLE THROUGH
ANY PATENT ISSUED PRIOR TO [[THE EFFECTIVE DATE OF THIS
ACT ON]] JUNE 1, 1967, OR TO THE PRESENT OR FUTURE RIGHTS
OF ANY PERSON UNDER §13-112.

REVISOR'S NOTE: This section presently appears as
Art. 21, §13-102(b) of the Code and is set
forth here for organizational purposes. New
language is added to clarify that the phrase
"any patent heretofore issued" in the existing
act refers to the effective date of Ch. 355,
of Acts of 1967, on June 1, 1967. The only
other changes are in style.

13-103. DESIGNATION OF ARCHIVIST; SEAL; GENERAL POWERS
AND DUTIES OF ARCHIVIST; NATURE OF PROCEEDINGS FOR
ISSUANCE OF PATENTS; SUMMONS; PERJURY; EMPLOYEES.

(A)   ARCHIVIST'S DUTIES IN GRANTING LAND PATENTS.

THE ARCHIVIST OF THE HALL OF RECORDS COMMISSION
SHALL PERFORM ALL DUTIES PROVIDED IN THIS TITLE. WHEN
PERFORMING THESE DUTIES, HE IS ACTING INDEPENDENTLY OF
HIS OTHER GENERAL POWERS, DUTIES, AND RESPONSIBILITIES AS
ARCHIVIST.

(B)   POWERS OF ARCHIVIST RELATING TO LAND PATENTS.

THE ARCHIVIST SHALL ISSUE ALL PATENTS AS PROVIDED IN
THIS TITLE. HE MAY ADOPT RULES AND REGULATIONS, NOT
INCONSISTENT WITH THIS TITLE, TO IMPLEMENT THE EFFECTIVE
ADMINISTRATION OF HIS DUTIES. IN THE EXERCISE OF THESE
DUTIES THE ARCHIVIST MAY:

(1)   ISSUE WARRANTS AND SUMMONS;

(2)    APPROVE CERTIFICATES OF SURVEY OR
RESURVEY;

(3)    CONDUCT HEARINGS ON ANY MATTER RELEVANT
TO THE ISSUANCE OF PATENTS;

(4)     ADMINISTER OATHS IN LAND PATENT
PROCEEDINGS; [[AND]]

(5)    DETERMINE WHETHER A PATENT MAY BE ISSUED
PURSUANT TO THIS TITLE[[.]]; AND

(6) ADOPT A SEAL FOR LAND PATENT
