TITLE 13. LAND PATENTS.
13-101. DEFINITIONS.

(A)    IN THIS TITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED UNLESS OTHERWISE APPARENT FROM

CONTEXT.

REVISOR'S NOTE: This subsection is new language
containing the standard introductory sentence
to a definition section as used in this
article. It has been renumbered because of
the proposed deletion of all of §13—101 in the
current title.

(B)   "AFFIDAVIT" MEANS AN OATH OR AFFIRMATION, SWORN
OR MADE BEFORE AN OFFICER OR OTHER PERSON AUTHORIZED TO
ADMINISTER AN OATH OR TAKE AN AFFIRMATION, THAT THE
MATTERS AND FACTS SET FORTH IN THE DOCUMENT TO WHICH IT
PERTAINS ARE TRUE AND COMPLETE TO THE BEST OF THE
AFFIANT'S KNOWLEDGE, INFORMATION, AND BELIEF.

REVISOR'S NOTE: This subsection presently appears as
Art. 21, §13-102(1) of the Code. No changes
are made.

(C)   "ARCHIVIST" MEANS THE ARCHIVIST APPOINTED BY
THE HALL OF RECORDS COMMISSION WHEN HE IS PERFORMING THE
DUTIES AND EXERCISING THE POWERS PROVIDED UNDER THIS
TITLE.

REVISOR'S NOTE: This subsection is new language
added to clarify the role of the archivist in
administering the Act.

(D)    "LAND" MEANS ANY CONTIGUOUS AREA, WHETHER
CULTIVATED OR UNCULTIVATED, WITHIN THE TERRITORIAL LIMITS
OF THE STATE, AND EXCLUDES ANY AREA COVERED BY NAVIGABLE
WATER UNLESS IT WAS INCLUDED IN A PATENT ISSUED PRIOR TO
MARCH 3, 1862.

REVISOR'S NOTE: This subsection presently appears as
Art. 21, §13-102(3) of the Code. The
definition of "vacant land" is proposed for
deletion from this subsection to create new
