UNLESS THE PUBLIC OR PRIVATE AGENCY IS SATISFIED THAT THE
BUSINESS (i) CANNOT BE RELOCATED WITHOUT A SUBSTANTIAL
LOSS OF ITS EXISTING PATRONAGE, AND (ii) IS NOT A PART OF
A COMMERCIAL ENTERPRISE HAVING AT LEAST ONE OTHER
ESTABLISHMENT NOT BEING ACQUIRED BY THE PUBLIC OR PRIVATE
AGENCY WHICH IS ENGAGED IN THE SAME OR SIMILAR BUSINESS.

REVISOR'S NOTE: This section presently appears as
Art. 21, §12-205 of the Code. The present
references to "real property" are proposed for
deletion for the reasons explained in the
revisor's note to §12—201(b). Present
subsection (c) is divided into paragraphs for
organizational purposes. The only other
changes are in style.

12-206. ADVISORY SERVICES.

(A)   GENERALLY.

IF THE ACQUISITION OF LAND FOR A PROGRAM OR PROJECT
UNDERTAKEN BY A PUBLIC OR PRIVATE AGENCY WILL RESULT IN
THE DISPLACEMENT OF ANY PERSON, THE PUBLIC OR PRIVATE
AGENCY SHALL PROVIDE A RELOCATION ASSISTANCE ADVISORY
PROGRAM FOR DISPLACED PERSONS WHICH SHALL OFFER THE
SERVICES DESCRIBED IN SUBSECTION (B). IF THE PUBLIC OR
PRIVATE AGENCY DETERMINES THAT ANY PERSON OCCUPYING
PROPERTY IMMEDIATELY ADJACENT TO THE LAND ACQUIRED IS
CAUSED SUBSTANTIAL ECONOMIC INJURY BECAUSE OF THE
ACQUISITION, IT MAY OFFER THAT PERSON RELOCATION ADVISORY
SERVICES UNDER THE PROGRAM.

(B)   DESCRIPTION OF MEASURES, FACILITIES OR SERVICES
TO BE PROVIDED.

EACH RELOCATION ASSISTANCE ADVISORY PROGRAM REQUIRED
BY SUBSECTION (A) INCLUDES THOSE MEASURES, FACILITIES, OR
SERVICES NECESSARY OR APPROPRIATE IN ORDER TO:

(1)    DETERMINE ANY NEED OF DISPLACED PERSONS
FOR RELOCATION ASSISTANCE;

(2)     PROVIDE CURRENT AND CONTINUING
INFORMATION ON THE AVAILABILITY, PRICES, AND RENTALS, OF
COMPARABLE DECENT, SAFE, AND SANITARY SALES AND RENTAL
HOUSING, AND OF COMPARABLE COMMERCIAL PROPERTIES AND
LOCATIONS FOR DISPLACED BUSINESSES;

(3)   ASSURE THAT, WITHIN A REASONABLE PERIOD
OF TIME, PRIOR TO DISPLACEMENT THERE WILL BE AVAILABLE IN
AREAS NOT GENERALLY LESS DESIRABLE IN REGARD TO PUBLIC
UTILITIES AND PUBLIC AND COMMERCIAL FACILITIES AND AT
TERMS OR PRICES WITHIN THE FINANCIAL MEANS OF THE
FAMILIES AND INDIVIDUALS DISPLACED, DECENT, SAFE AND
