DISTRICTS, PROVIDED:

COUNTY LOCAL LAWS

(1)    OFF-STREET PARKING IS PROVIDED IN ACCORDANCE
WITH THE PROVISIONS OF ARTICLE VIII, "OFF-STREET
PARKING", OF THIS SUBTITLE.

(2)    NO SOLICITING FOR CUSTOMERS SHALL BE PERMITTED
OUTSIDE OF THE ESTABLISHMENT,

(3)   THE ZONING HEARING OFFICER SHALL PRESCRIBE
APPROPRIATE CONDITIONS AND SAFEGUARDS TO MINIMIZE ADVERSE
EFFECTS TO THE SURROUNDING AREA (INCLUDING BUT NOT
LIMITED TO REQUIREMENTS FOR SOUNDPROOFING).

(4)   THE APPLICATION FOR SPECIAL EXCEPTION SHALL
INDICATE A SCHEDULE SHOWING TIME OF OPERATION,
DESCRIPTION OF TYPE OF ENTERTAINMENT, AND THE PROPOSED
ANCILLARY USES.

SECTION 13-3113.17B

SPECIAL EXCEPTION FOR ESTABLISHMENTS TO BE USED AS
MASSAGE PARLORS SHALL BE PERMITTED IN C2 - COMMERCIAL
OFFICE DISTRICTS, C3 - GENERAL COMMERCIAL DISTRICTS AND
C4 - HIGHWAY COMMERCIAL DISTRICTS AND TC - TOWN CENTER
DISTRICTS, PROVIDED:

(1)     THE REQUIREMENTS SET FORTH IN SECTIONS
13-343.17A (1), (2) AND (3) OF THIS ARTICLE ARE MET.

(2)   THE APPLICATION FOR SPECIAL EXCEPTION SHALL
INDICATE THE TYPE OF SERVICE OFFERED, AND THE PROPOSED
ANCILLARY USES.

SECTION 2. AND BE IT FURTHER ENACTED, That upon the
adoption of additional sections of this Subtitle, the
Article, Headings, Subsections or Sections of this
ordinance may be re—numbered or rearranged to establish
an orderly numbering system for the entire Subtitle, and
to correct cross—references (provided that no changes or
other than typographical corrections may be made to the
language or substance thereof).

SECTION 3. AND BE IT FURTHER ENACTED, That if any
provision of this ordinance or the application thereof to
any person or circumstance is held invalid for any
reason, such invalidity shall not affect the other
provisions or any other application of this ordinance
which can be given effect without the invalid provisions
or application, and to this end, all the provisions of
this ordinance are hereby declared to be severable.

SECTION 4. AND BE IT FURTHER ENACTED, That this
ordinance shall take effect forty—five (45) days from the
