MUNICIPAL CHARTERS

—17.71.Walls, fences, hedges, vines and shrubbery — To
regulate the height of vails, fences and hedges on or
along any street, sidewalk, alley or lane and to provide
for their trimming, removal or set back.

-17.72.Weeds, refuse, etc. - To provide for removal of
weeds and refuse from improved or unimproved lots and
assess the costs against the owner of the property.

17.73. Enumeration not exclusive — The enumeration of
powers in this section is not to be construed as limiting
the powers of the Town to the several subjects mentioned.

63—18. Exercise of Powers

For the purpose of carrying out the powers granted
in this Charter, the Council may pass all necessary
ordinances. All the powers of the Town shall be
exercised in the manner prescribed by this Charter, or if
the manner be not prescribed, then in such a manner as
may be prescribed by ordinance.

63—19. Enforcement of ordinances

To assure the observance of the ordinances of the
Town, the Council has the power to provide that violation
thereof shall be a misdemeanor or unlawful and has the
power to affix thereto penalties of a fine not exceeding
$100 or imprisonment for not exceeding 90 days or both
such fine and imprisonment. Any person subject to any
fine, forfeiture or penalty by virtue of any ordinance
passed under the authority of this Charter has the right
of appeal within 10 days as provided by the general law
of the State. The Council may provide that if the
violation is of a continuing nature and is persisted in,
a conviction for one violation shall not be a bar to a
conviction for a continuation of the offense subsequent
to the first or any succeeding convictions.

63-20. Separability

If any section or part of this Charter is held
invalid by a Court of competent jurisdiction this holding
shall not affect the remainder of this Charter or the
context in which such section or part of section as held
invalid appears, except to the extent that an entire
section or part of section may be inseparably connected
and effect with the section or part of section to which
such holding shall directly apply.
