SECTION 2: AND BE IT FURTHER RESOLVED   AND ORDAINED

BY THE COMMISSIONERS OF HEBRON, that     this Charter

amendment shall, take effect fifty (50) days   from the date
of the passage thereof.

PASSED: May 2, 1973.

RESOLUTION NO. 2-1973
ENTITLED

A Resolution and Ordinance to add a new Section 157A
to Article 23 of the Code of Public Local Laws of
Wicomico County (1955 Edition) to follow immediately
after Section 157 thereof, title "Hebron", sub—title
"Benefit Assessments, Charges and Collection", relating
to payment of annual benefit charges for sewer service,
classification of property and the collection of such
charges.

SECTION 1. BE IT RESOLVED AND ORDAINED BY THE
COMMISSIONERS OF HEBRON, by virtue of the authority
granted in Article 11E of the Constitution of Maryland,
that new Section 157A be and it is hereby added to
Article 23 of the Code of Public Local Laws of Wicomico
County (1965 Edition) title, "Hebron", sub-title "Benefit
Assessments, Charges and Collection" and to read as
follows:

157A BENEFIT ASSESSMENTS, CHARGES AND COLLECTION.

(A)    BENEFIT ASSESSMENTS. FOR THE PURPOSE OF
PAYING THE INTEREST AND PRINCIPAL OF THE BONDS ISSUED BY
THE COMMISSIONERS, AS PROVIDED IN SECTION 157 OF THIS
ARTICLE, TO PAY FOR THE SEWERAGE SYSTEM AND SEWAGE
TREATMENT PLANT FOR THE TOWN OF HEBRON, THE COMMISSIONERS
ARE HEREBY AUTHORIZED AND DIRECTED TO FIX AN ANNUAL
ASSESSMENT ON ALL PROPERTIES, IMPROVED OR UNIMPROVED,
WHICH ARE DIRECTLY BENEFITED BY THE INSTALLATION. THE
ANNUAL ASSESSMENT SHALL BE MADE UPON THE FRONT FOOT
BASIS, AND THE FIRST PAYMENT SHALL BE COLLECTED DURING
THE FISCAL YEAR OF SAID TOWN IN WHICH THE CONSTRUCTION IS
COMPLETED.

(B)    CLASSIFICATIONS. ALL PROPERTY SUBJECT TO
BENEFIT ASSESSMENTS FOR SAID SEWER SHALL BE DIVIDED INTO
FOUR CLASSES, NAMELY: AGRICULTURAL, INDUSTRIAL,
COMMERCIAL AND RESIDENTIAL. THE COMMISSIONERS SHALL IN
WRITING NOTIFY ALL OWNERS OF SAID PROPERTIES INTO WHICH
CLASS THEIR RESPECTIVE PROPERTIES FALL AND THE CHARGE
DETERMINED THEREFOR, NAMING ALSO IN SAID NOTICE A TIME
