MUNICIPAL CHARTERS

NORTHEASTERLY LINE OF THE SHARP'S POINT ROAD IN A
NORTHERLY DIRECTION TO THE PROJECTED LINE OF OTHER LAND
OF SAID ORVILLE H. PRYOR; THENCE (22) IN A SOUTHWESTERLY
DIRECTION IN A STRAIGHT LINE TO THE POINT FORMED BY THE
INTERSECTION OF THE PROPERTY LINES OF PROPERTIES NOW OR
FORMERLY OWNED BY GERALD DESMOND, IRENE F. COLONNA AND
JACK R. TOWNSEND; THENCE (23) IN A SOUTHEASTERLY
DIRECTION IN A STRAIGHT LINE TO AND ACROSS THE
FRUITLAND-ALLEN ROAD (COUNTY ROAD 344) TO THE
NORTHWESTERLY CORNER OF THE LAND FORMERLY OWNED BY SARA
TILGHMAN; THENCE (24) BY AND WITH THE SOUTHWESTERLY

THE COUNCIL

SECTION 110. VESTING OF LEGISLATIVE POWER; COMPOSITION;
ELECTION GENERALLY AND TERM OF COUNCILMEN.

ALL LEGISLATIVE POWERS OF THE CITY SHALL BE VESTED
IN A COUNCIL OF FIVE MEMBERS WHO SHALL BE ELECTED AS
HEREINAFTER PROVIDED AND WHO SHALL HOLD OFFICE FOR A TERM
OF FOUR (4) YEARS OR UNTIL THEIR SUCCESSORS ARE DULY
ELECTED AND QUALIFIED. THE REGULAR TERM OF COUNCILMEN
SHALL EXPIRE ON THE FIRST TUESDAY OF THE MONTH FOLLOWING
THE ELECTION OF THEIR SUCCESSORS.

SECTION 110A. COMPOSITION AND TERM.

(1)    THE CORPORATE POWERS OF THE CITY OF FRUITLAND
SHALL BE VESTED IN AND SHALL BE EXERCISED BY A COUNCIL OF
FIVE MEMBERS TO BE KNOWN AS THE CITY COUNCIL, WHO SHALL
BE ELECTED FROM THE CITY AT LARGE, SHALL HOLD OFFICE FOR
A TERM OF FOUR (4) YEARS OR UNTIL THEIR SUCCESSORS ARE
DULY ELECTED AND QUALIFY BY TAKING AN OATH ADMINISTERED
BY THE CITY CLERK THAT HE WILL DILIGENTLY AND FAITHFULLY
DISCHARGE ALL THE DUTIES OF HIS OFFICE. THE REGULAR TERM
OF COUNCILMEN SHALL EXPIRE ON THE FIRST TUESDAY OF THE
MONTH FOLLOWING THE ELECTION OF THEIR SUCCESSORS.
ELECTION OF COUNCILMEN SHALL BE AS PROVIDED IN SECTION
4.07 HEREOF.

(2)    OFFICERS. THE NEW CITY COUNCIL SHALL, AT ITS
FIRST MEETING, FOLLOWING A REGULAR CITY ELECTION, CHOOSE
ONE OF ITS MEMBERS AS PRESIDENT AND ANOTHER OF ITS
MEMBERS AS TREASURER, AND THE MEMBERS SO CHOSEN SHALL
SERVE IN SUCH CAPACITIES FOR A PERIOD OF TWO (2) YEARS OR
UNTIL THEIR SUCCESSORS ARE DULY ELECTED AND QUALIFIED.
THE CITY SOLICITOR SHALL PRESIDE DURING REORGANIZATION OF
