OF THE ORIGINAL. APPLICANTS SHALL PAY THE REASONABLE FEE
FIXED BY THE STATE COMPTROLLER OR THE OFFICER TO COVER
THE COST OF PREPARATION OF THE COPIES.

REVISOR'S NOTE: This section presently appears as
Art. 21, §9-112 of the Code. In subsection
(a) new definitions are proposed to clarify
the words "contractor" and "public body" as
used in this section.

In subsection (c) new language is added to
make parallel that the "terms and amount"
provided in subparagraph (ii) are subject to
approval by the public body just as is the
bond provided in subparagraph (i).

In subsection (e) the reference to "certified
mail" is proposed for deletion because Art. 1,
§20 provides that this is included in the
phrase "registered mail."

In subsections (h) and (i) new language is
proposed so that bonds shall be filed either
in the "main office of the State contracting
agency" or in the "main office of the
concerned public body" in order to enact what
is both reasonable and the current practice
despite the statutory requirement. In
subsection (i) the phrase "is authorized and
directed to" is proposed for deletion and the
word "shall" substituted to conform with the
stylistic guidelines of the Commission.

ALTERATION, OR REPAIR OF ANY PUBLIC BUILDING OR PUBLIC

WORK OR IMPROVEMENT OF THE STATE OF MARYLAND, OR OF ANY

COUNTY, CITY, MUNICIPAL CORPORATION, TOWN, BOARD OF

EDUCATION OR OTHER POLITICAL SUBDIVISION, PUBLIC

AUTHORITY, OR PUBLIC INSTRUMENTALITY, OR ANY OFFICER,

BOARD, COMMISSION, OR AGENCY OF ANY OF THE FOREGOING, IS
AWARDED TO ANY PERSON, HE SHALL FURNISH TO THE STATE OF
MARYLAND, OR TO SUCH COUNTY, CITY, MUNICIPAL CORPORATION,

TOWN, OR OTHER POLITICAL SUBDIVISION, PUBLIC AUTHORITY,

OR PUBLIC INTRUMENTALITY, OR TO SUCH OFFICER, BOARD,

COMMISSION, OR AGENCY THEREOF, THE FOLLOWING BONDS WHICH

SHALL BECOME BINDING UPON THE AWARD OF THE CONTRACT TO

SUCH PERSON, WHO IS HEREINAFTER DESIGNATED AS

"CONTRACTOR":

(1) A PERFORMANCE BOND EXECUTED BY A SURETY
COMPANY AUTHORIZED TO DO BUSINESS IN THIS STATE
