EASTON
Resolution of the Town of Easton, adopted pursuant
to the authority of Article 11E of the Constitution of
Maryland, and Section 13 of Article 23A of the Annotated
Code of Maryland (1966 Repl. Vol.) titled "Corporations —
Municipal", sub—title "Home Rule", sub—heading "Charter
Amendments", to amend Article V, Sec. 1 of the Charter of
the Town of Easton, which Section is headed "Elections,
Registrations and Nominations"; to eliminate the one year
residency requirement and to provide that bona fide
residents who are registered may vote in Town of Easton
elections.
SECTION 1. On or about February 19, 1973, the
Council of the Town of Easton passed Resolution No. 38
designed to eliminate the one year residency requirement
for voting in Town of Easton elections, which Resolution
provided for publication by the Easton Star Democrat for
four consecutive weeks commencing March 7, 1973, which
publication is required by Article 23A of the Annotated
Code of Maryland, but said newspaper failed to publish
the required notice during the week of March 14, 1973 and
as a consequence thereof, it has been necessary to
readopt Resolution No. 38 which readoption is the purpose
of this Resolution.
SECTION 2. BE IT RESOLVED BY THE COUNCIL OF THE
TOWN OF EASTON, that Article V, Sec. 1 of the Charter of
the Town of Easton being a part of Article 21 of the Code
of Public Local Laws of Maryland (1930 Edition), as
amended, titled "Talbot County", sub-title "Easton", be
and the same is hereby amended to read as follows:
Sec. 1. All elections shall be by ballot, and every
citizen of the age of eighteen years or
upwards, who is a citizen of the United States
and who [has been] IS a bona fide resident of
the Town of EASTON [for one year next
preceding the election] and whose name shall
appear upon the list of registered voters of
the town, as hereinafter provided, shall be
entitled to vote at all elections hereafter to
be held; but no person who has been convicted
of larceny or other infamous crime, unless
pardoned by the President or the Governor,
shall ever be entitled to vote at any town
election, and no person under guardianship as
a lunatic or as a person "non compos mentis,"
shall be entitled to vote.
SECTION 3. AND BE IT FURTHER RESOLVED, that the
date of adoption of this Resolution is March 19, 1973,
and the amendment of the Charter of the Town of Easton
