CUMBERLAND

COUNCIL OF CUMBERLAND, MARYLAND, That subsection (k) of
Section 36 of the Charter of the City of Cumberland (1966
Edition, as amended) be and is hereby repealed and
re—enacted, with amendments, to read as follows:

"(k) No person shall be employed in any capacity in
the Fire or Police Department unless he is a citizen of
the United States, and is of good moral character and can
read and write the English language, and is not addicted
to the use of intoxicating beverages or narcotic drugs.
[All employees of the Fire or Police Department shall
become a resident of the City of Cumberland within ninety
days after permanent appointment]. ALL APPLICANTS FOR
POSITIONS IN THE POLICE AND FIRE DEPARTMENTS SHALL BE
RESIDENTS OF THE CITY OF CUMBERLAND FOR AT LEAST SIX (6)
MONTHS IMMEDIATELY PRIOR TO THE FILING OF SUCH
APPLICATION FOR EMPLOYMENT AND, IF APPOINTED TO EITHER OF
SAID DEPARTMENTS, SHALL REMAIN A RESIDENT OF THE CITY AS
A CONDITION OF CONTINUED EMPLOYMENT.

SECTION 2: AND BE IT FURTHER RESOLVED, That the
date of the passage of this Resolution is April 24, 1973,
and the amendments to the Charter of the City of
Cumberland, hereby enacted shall become effective on June
13, 1973, unless a proper Petition for a Referendum
hereon shall be filed as provided by Section 13 of
Article 23A of the Annotated Code of Maryland, and
provided a complete and exact copy of this Resolution
shall be continuously posted on the North Centre Street
entrance of the City Hall, Cumberland, Maryland, until
June 3, 1973, and provided further that a fair summary of
the proposed amendments shall be published in the
Cumberland Evening Times, a newspaper of general
circulation in the City of Cumberland once in each of the
weeks of April 30, May 7, 14, 21, 28, 1973.

SECTION 3: AND BE IT FURTHER RESOLVED, That the
Mayor of the City of Cumberland is hereby specifically
directed to carry out the provisions of Section 2 hereof,
regarding the giving of notice by posting and publication
of this Resolution approving the same, and, as evidence
of said compliance, the City Clerk shall cause to be
affixed hereto a certificate of publication of the
newspaper in which the summary of this Resolution shall
have been published, and the Mayor, if there is no
Petition for a Referendum, shall declare the Charter
Amendment made to be effective on the effective date
herein provided for, which is June 13, 1973, by affixing
his signature hereto in the space provided below the
effective date hereof.

SECTION 4: AND BE IT FURTHER RESOLVED, That, if a
proper Petition for a Referendum on the Charter Amendment
herein proposed is filed, the Mayor and other proper
