Dear Governor Mandel:
I would like to urge you to veto House Bill 1636.
This bill, which would require pharmacists to place the
label, "This medication may impair your driving ability,"
when certain drugs are dispensed would not be an
effective law. First, not all the types of drugs that
are listed will necessarily impair driving ability. In
addition, those drugs that might impair driving ability
cause varying effects in patients, and it should be the
judgment of the physician or pharmacist to determine
which prescription should be so labeled. This is
presently done by both practitioners. I would like to
also point out that there are some drugs that are not
listed in this bill that may have an adverse effect on
driving habits of individuals.
If this bill was intended to primarily aid police in
their efforts to detail whether a particular drug is
causing an impairment of driving ability, I would suggest
that there are other more effective ways that this could
be accomplished.
