ACCORDANCE WITH REGULATIONS PROMULGATED BY THE STATE
SUPERINTENDENT OF SCHOOLS. THE BALTIMORE CITY BOARD OF
SCHOOL COMMISSIONERS OR THE BOARD OF EDUCATION OF EACH
COUNTY MAY MAKE ROLES AND REGULATIONS, NOT INCONSISTENT
WITH THE STATE REGULATIONS, CONCERNING THE TRANSPORTATION
OF CHILDREN IN THESE NONPUBLIC SCHOOLS, PROVIDED THAT ALL
RULES AND REGULATIONS CONCERNING TRANSPORTATION OF
CHILDREN ENROLLED IN NONPUBLIC SCHOOLS SHALL BE THE SAME
AS THOSE APPLICABLE TO CHILDREN ENROLLED IN PUBLIC
SCHOOLS.

(B) EACH YEAR THE STATE SUPERINTENDENT OF PUBLIC
SCHOOLS SHALL CONFER WITH THE BALTIMORE CITY BOARD OF
SCHOOL COMMISSIONERS AND EACH COUNTY BOARD OF EDUCATION,
AND WITH THE APPROPRIATE NONPUBLIC SCHOOL OFFICIALS, IN
ORDER TO ESTIMATE FOR THE ENSUING FISCAL YEAR THE AMOUNT
NEEDED TO PURCHASE, PROVIDE AND ADMINISTER THE
TRANSPORTATION SERVICES IN ALL OF THE COUNTIES AND
BALTIMORE CITY. THEREAFTER, THE SUPERINTENDENT SHALL
SUBMIT THE ESTIMATE OF THE TOTAL AMOUNT TO PROVIDE THE
TRANSPORTATION SERVICES IN BALTIMORE CITY AND THE
COUNTIES TO THE OFFICIALS CHARGED WITH PREPARING THE
EXECUTIVE BUDGET. THE STATE OF MARYLAND SHALL PROVIDE
THE BALTIMORE CITY BOARD OF SCHOOL COMMISSIONERS AND THE
COUNTY BOARDS OF EDUCATION WITH THE FUNDS NECESSARY TO
PROVIDE THE TRANSPORTATION SERVICES REQUIRED UNDER THIS
SECTION.

(C) IN NO EVENT MAY THE AVERAGE COST FOR

TRANSPORTATION OF A NON-PUBLIC SCHOOL CHILD EXCEED THE

AVERAGE COST FOR TRANSPORTATION OF A PUBLIC SCHOOL CHILD

IN THE SAME COUNTY (OR BALTIMORE CITY) IN WHICH THE

NON-PUBLIC SCHOOL IS LOCATED.

SECTION 2. AND BE IT FURTHER ENACTED, That if any
provision of this Act or the application thereof to any
person or circumstance is held invalid for any reason,
the invalidity shall not affect the other provisions or
any other application of this Act which can be given
effect without the invalid provisions or application, and
to this end all the provisions of this Act are declared
to be severable.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
