In any case involving a child who has reached his
fourteenth (14th) birthday but has not reached his
eighteenth (18th) birthday at the time of any alleged
offense excluded under the provisions of [§70—2(d) (1) or
(3) of Article 26,] §3-808 OF THE COURTS ARTICLE OF THE
CODE, the court exercising jurisdiction nay transfer the
case to the juvenile court if a waiver is believed to be
in the interests of the child and/or society.

(a) (5) Supplemental Powers of District Court Judge;
Revocation, Change, or Modification of Release;
Termination of Release; Probation. This section is
supplemental to the powers of the District Court judge
contained in [Article 26, §§ 146 and 147] §643A OF
ARTICLE 27, At any time during the period of confinement
imposed by the judge he may (i) revoke, change or modify
any release, or the conditions of such release, under
this section in the manner and to the extent provided by
Article 27, §700A, (ii) release any prisoner under the
provisions of this section, notwithstanding that he has
already served part of a sentence previously imposed, or
(iii) terminate any release pursuant to this section and
place any person under probation as provided in [Article
26, §146] §643 OF ARTICLE 27 OF THE CODE.

SECTION 4. AND BE IT FURTHER ENACTED, That Sections
2 (c), and 7(a) of Article 27A — Public Defender, of the
Annotated Code of Maryland (1971 Replacement Volume and
1973 Supplement) be and they are hereby repealed and
re—enacted, with amendments, to read as follows:

Article 27A - Public Defender
2.

(c) "District" means an area comprising one or more
political subdivisions conforming to the geographic
boundaries of the District Court districts established in
[Article 26, §140, of the Annotated Code of Maryland]
§1-602 OF THE COURTS ARTICLE OF THE CODE.

7.

(a) Eligibility for the services of the Office of
the Public Defender shall be determined on the basis of
the need of the person seeking legal representation.
Need shall be measured according to the financial ability
of the person to engage and compensate competent private
counsel and to provide all other necessary expenses of
representation. Such ability shall be recognized to be a
