(1972 Replacement Volume and 1973 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 22 (b) of Article 64A - Merit
System, of the Annotated Code of Maryland (1972
Replacement Volume and 1973 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:

Article 64A - Merit System
22.

(b) If the Secretary receives a requisition for the
appointment of a person to a permanent position for which
no eligible list exists he shall forthwith call an
examination and he may if necessary to prevent the
stoppage of public business, and not otherwise, certify a
qualified person for temporary appointment, with or
without examination, and such person shall be appointed
by the appointing authority, provided, however, that such
temporary appointment shall be pending the establishment
of an eligible list only[.] [[; AND PROVIDED FURTHER THAT
NO SUCH APPOINTMENT SHALL BE MADE FOR A PERIOD EXCEEDING
SIX MONTHS]]. THE SECRETARY IS REQUIRED TO ESTABLISH AN
ELIGIBLE LIST WITHIN SIX MONTHS FROM THE DATE A

REQUISITION FOR SUCH A LIST IS RECEIVED.___IN__ANY CASE

WHERE A TEMPORARY APPOINTMENT IS MADE PENDING THE

ESTABLISHMENT OF ANY ELIGIBLE LIST THE EMPLOYEE__SHALL

CONTINUE IN A TEMPORARY STATUS UNTIL ANY ELIGIBLE LIST
HAS BEEN ESTABLISHED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
