affecting the right of the various boards of education,
on their own behalf, from raising the defense of
sovereign immunity to any amount in excess of the limit
of the policy or in excess of one hundred thousand
dollars ($100,000) in the case of self—insurance.]

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 56B(d) be and it is hereby added to Article 77 —
Public Education, of the Annotated Code of Maryland (1969
Replacement Volume and 1973 Supplement) to read as
follows:

56B.

(D) THE SEVERAL BOARDS OF EDUCATION ON THEIR OWN
BEHALF MAY RAISE THE DEFENSE OF SOVEREIGN IMMUNITY TO ANY
AMOUNT IN EXCESS OF THE LIMIT OF THE POLICY OR IN EXCESS
OF $100,000 IN THE CASE OF SELF-INSURANCE. IN ANY CASE,
THE SEVERAL BOARDS OR ANY BOARD OF EDUCATION MAY NOT
RAISE THE DEFENSE OF SOVEREIGN IMMUNITY IN ANY CLAIM OF
LESS THAN $100,000.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
